May 31, 1976POLICY INSTRUCTIONS NO. 18-76Presidential Decree No. 928 increased the statutory minimum wage from P8.00 to P10.00 a day as of May 1, 1976. The Rules and Regulations implementing the said Presidential Decree failed to mention a policy on the matter of the wages of apprentices.Among others, Article 61 of the Labor Code, as amended, provides ". . . Apprenticeship agreements providing for wage rates below the legal minimum wage, which in no case shall start below seventy-five per cent of the applicable minimum wage, may be entered into in accordance with the apprenticeship programs recognized by the Bureau of Apprenticeship. . . ." The policy is that whenever there is any change of the statutory minimum wage, a corresponding change shall likewise be made in the wages of apprentices. It will follow that all apprenticeship agreements entered into before May 1, 1976, under recognized apprenticeship programs the wage rates of which were based on the old minimum wage, shall be considered automatically amended as of May 1, 1976, insofar as their wage clauses...
