Leano II, the dispositive portion of which reads: WHEREFORE, premises considered, the instant petition for certification election is hereby DISMISSED for want of an employer-employee relationship between HCPTI and members of the petitioner.SO ORDERED.The facts of the case are as follows:On 07 May 2012, MHPWU-PWUP, a legitimate labor organization with Registration Certificate No. NCR-MFO-UR-03-2012-002, filed a petition for certification election seeking to represent an estimated one thousand two hundred (1,200) rank-and-file employees of Harbour Centre Port Terminals, Inc.
