NORECO II, respondents-appellant.RESOLUTIONThis resolves the Memorandum of Appeal filed by the Negros Oriental II Electric Cooperative, Inc. from the Order dated 05 January 2016 of DOLE VII-Mediator-Arbiter Roy L. Buenafe, the dispositive portion of which reads: WHEREFORE, premises considered and pursuant to Section 19, Rule IX of Department Order No. 40-03, series of 2003 as amended, it is hereby declared that "NORECO II SUPERVISORY UNION — APSOTEU-TUCP" obtained the majority of the valid votes cast in the certification election.SO ORDERED.The facts are as follows:On 30 July 2015, NORECO II Supervisory Union APSOTEU-TUCP (NORECO-APSOTEU-TUCP, for brevity), a legitimate labor organization with Certificate of Local Creation No. RO700-NOFO-2015-07-LC-001, filed a Petition for Certification Election seeking to be the sole and exclusive bargaining agent of the supervisory employees of the Negros Oriental II Electric Cooperative, Inc.
