January 14, 1983POEA MEMORANDUM ORDER NO. 002-A-83REGULATING PRIVATE SECTOR PARTICIPATION IN RECRUITMENT AND OVERSEAS PLACEMENTPursuant to the power vested by Executive Order 797 to the Philippine Overseas Employment Administration to regulate private sector participation in the recruitment and overseas placement offenses committed by licensed employment agencies, shipping/manning agencies and contracting companies, to take effect on 15 January 1983, is hereby promulgated. NATURE OF OFFENSEPENALTY    First OffenseSubsequent Offense     1.Charging orSuspension ofCancellation of collecting andocumentarylicense or authority amount notprocessing until case  authorized by POEAis settled but in no  but not to exceedcase less than two (2)  P50,000.00months, plus fine equivalent  to the amount collected.      2.Charging or collectingSuspension ofCancellation of an amount notlicense or authoritylicense or authority authorized or in excessuntil case is settled  of that authorized bybut in no case less  POEA when the amountthan six (6) months,  collected exceedsplus fine equivalent to  P50,000.00 but notthe amount collected.  P200,000.00      3.Charging or collectingSuspension ofCancellation of an amount not authorizedlicense or authoritylicense or authority by POEA when the amountuntil case is settled  collected exceedsbut in no case lower  P200,000.00...
