October 19, 2004NLRC MEMORANDUM CIRCULAR NO. 10-01-04FOR:All Executive Labor Arbiters/Labor Arbiters, Sheriffs/Acting Sheriffs, Computation Units and All Concerned Personnel This Commission RE:Strict Application of the Rule on Collection of Execution Fees Rule IX, Section 6, second paragraph of the manual on Execution of Judgment (as amended by Resolution No. 02-02, Series of 2002) provides that:"The Sheriff or duly designated officer shall collect the following execution fees which shall be charged against the losing party: EcASIC1. For award less than P5,000.00 - P200.00;2. P5,000.00 or more but less than P20,000.00 - P400.00;3. P20,000.00 or more but less than P50,000.00 - P600.00;4. P50,000.00 or more but less than P100,000.00 - P800.00;5. P100,000.00 or more but not exceeding - P1,000.00 P150,000.00;6. P150,000.00 the fee is plus P10.00 for every P1,000.00 in excess of P150,000.00. The Sheriff or duly designated officer shall be administratively liable in case of failure to collect and remit the execution fees without any justifiable reason."
