Abolishing the General Services Administration and Transferring Its Functions To Appropriate Government Agencies

Executive Order No. 285

EXECUTIVE ORDER NO. 285 July 25, 1987

ABOLISHING THE GENERAL SERVICES ADMINISTRATION AND TRANSFERRING ITS FUNCTIONS TO APPROPRIATE GOVERNMENT AGENCIES

WHEREAS, it is the policy of the government to promote economy, efficiency and effectiveness in the delivery of public services;

WHEREAS, the successful performance by line departments and agencies of their mandated tasks can only be assured if auxilliary services are likewise adequately provided;

WHEREAS, in line with the principles of decentralization, autonomy and accountability, general services functions pertaining to building and real property management and supply coordination should be integrated with the regular responsibilities of government agencies having related functions;

WHEREAS, it is desirable to continue centralized coordination of records management and archival functions; and

WHEREAS, the need for an effective government printing and publication system requires the rationalization of all related existing resources of the government.

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order:

Summary of Executive Order No. 285

Declaration of Policy (Sec. 1)
- Decentralization, autonomy, accountability, and optimization of government resources in conducting general administration functions.

Abolition of the General Services Administration (GSA) (Sec. 1)
- The GSA, its Building Services and Real Property Management Office, and Supply Coordination Office are abolished.
- Their functions are transferred to other agencies, including applicable appropriations, records, property, equipment, and necessary personnel.

Transfer of GSA Functions (Sec. 2-6)
- Building and Real Property Management Functions:
    - To Department of Public Works and Highways (DPWH) (Sec. 3.1)
        - Custody and administration of government buildings
        - Research, studies, and surveys on space requirements and building maintenance
        - Inventory, inspection, appraisal, and valuation of government buildings
        - Guidelines on rental rates for government buildings
        - Disposal of government-owned buildings
        - Damage assessment for insurance claims
        - Designation of building administrators
    - To Department of Environment and Natural Resources (DENR) (Sec. 3.2)
        - Custody and administration of commercial, industrial, and urban properties
        - Sale, lease, rental, or transfer of these properties
    - To Systems and Procedures Bureau, Department of Budget and Management (DBM) (Sec. 3.3)
        - Development of standards and guidelines on office space allocation and "housekeeping" services
    - To Building Administrators designated by DPWH (Sec. 3.4)
        - Allocation of office space in the building, subject to DBM guidelines
    - To Occupants of Government Buildings (Sec. 3.5)
        - Day-to-day custody and administration of buildings
        - Allocation of office space and rental of excess space
        - Ordinary repair and maintenance
        - Provision of "housekeeping" services, subject to DBM guidelines
- Supply Coordination Functions:
    - To Procurement Service, DBM (Sec. 4.1)
        - Operation of government-wide procurement for common-use office supplies
        - Monitoring of prices for common-use supplies, materials, and equipment
    - To Systems and Procedures Bureau, DBM (Sec. 4.2)
        - Development of standards and specifications for common-use supplies, materials, and equipment
        - Design of an integrated supply management system for government
        - Conduct of studies to improve the government purchasing system
    - To Different Line Departments and Agencies (Sec. 4.3)
        - Procurement of supplies, materials, and equipment peculiar to their operations
        - Disposal of obsolete, forfeited, abandoned, and surplus supplies, equipment, and materials, subject to DBM guidelines and existing laws
- Records Management and Archives Office transferred to Department of Education, Culture and Sports (DECS) as a cultural agency (Sec. 5)
- Creation of the National Printing Office (Sec. 6)
    - Merger of Government Printing Office and relevant printing units of Philippine Information Agency
    - Exclusive printing jurisdiction over standard and accountable forms, official ballots, and public documents
    - May accept other government printing jobs, but not exclusively
    - Attached to the Philippine Information Agency

Miscellaneous Provisions (Sec. 7-14)
- New structure and staffing pattern to be approved by Secretary of Budget and Management within 120 days (Sec. 7)
- Notice or consent requirement for organizational changes that may prejudice third-party rights (Sec. 8)
- Prohibition against unauthorized changes in the prescribed organization (Sec. 9)
- Funding from available funds in GSA and its four bureaus (Sec. 10)
- Implementing authority of Secretary of Budget and Management (Sec. 11)
- Separability clause (Sec. 12)
- Repealing clause for inconsistent laws, ordinances, rules, regulations, and issuances (Sec. 13)
- Effectivity clause (Sec. 14)
