PRESIDENTIAL DECREE No. 191 May 11, 1973

ABOLISHING THE MASS MEDIA COUNCIL CREATED UNDER PRESIDENTIAL DECREE NO. 36, AND CREATING IN ITS STEAD THE MEDIA ADVISORY COUNCIL, PRESCRIBING RULES AND REGULATIONS TO ENABLE THE NEW BODY TO DISCHARGE ITS FUNCTIONS EFFECTIVELY

WHEREAS, it is the objective of Government to help in the sound development of the mass media to the end that they would become an effective instrument in the attainment of social change;

WHEREAS, the various sectors of mass media have shown full appreciation of the fact their failure to institute self-regulatory measures that would regulate corruption and abuse in the media resulted, as it could only result, in Government having to intervene in order to ensure that private rights and public welfare are safeguard;

Summary of Presidential Decree No. 191

Abolition of Mass Media Council and Creation of Media Advisory Council
- Abolishes the Mass Media Council created under Presidential Decree No. 36. (Section 3)
- Creates the Media Advisory Council in its place, headed by the President of the National Press Club as chairman and a recognized civic leader appointed by the President as co-chairman. (Section 3)
- Members include representatives from the Manila Overseas Press Club, print, radio, television, and others designated by the President. (Section 3)

Duties and Functions of the Media Advisory Council
- Passing upon applications of mass media for permission to operate by issuing a Certificate of Authority to Operate, which must be approved by the President. (Section 3)
- The Certificate of Authority to Operate is valid for six (6) months and renewable every six (6) months, unless terminated earlier. (Section 3)
- Existing publications with a valid Certificate of Authority at the time of this Decree can continue operating until the expiration of their existing permit. (Section 3)
- Promulgate rules and regulations, guidelines, and sanctions for the operation of mass media within 15 days of organization, subject to the President's approval. (Section 3)
- Assume the functions and prerogatives of the defunct Philippine Press Council and the Press Consultative Panel, insofar as they conform with the requirements of this Decree. (Section 3)
- Set up a secretariat to perform functions and duties entrusted by the Media Advisory Council. (Section 3)
- Submit a monthly report to the President on actions taken and recommendations on matters affecting the operation of mass media. (Section 3)

Implementation and Effectivity
- This Decree is made part of the law of the land and takes effect immediately. (Section 3)
- It remains in force unless otherwise ordered by the President or his authorized representative. (Section 3)
