EXECUTIVE ORDER NO. 13
ABOLISHING THE PRESIDENTIAL ANTI-GRAFT COMMISSION AND TRANSFERRING ITS INVESTIGATIVE, ADJUDICATORY AND RECOMMENDATORY FUNCTIONS TO THE OFFICE OF THE DEPUTY EXECUTIVE SECRETARY FOR LEGAL AFFAIRS, OFFICE OF THE PRESIDENT
WHEREAS, this administration has a continuing mandate and advocacy to fight and eradicate corruption in the different departments, bureaus, offices and other government and instrumentalities;
WHEREAS, the government adopted a policy of streamlining the government bureaucracy to promote economy and efficiency in government;
WHEREAS, Section VII of the 1987 Philippine Constitution provides that the President shall have control of all the executive departments, bureaus, and offices;
WHEREAS, Section 31 Chapter 10, Title, Book III, Book III Executive Order 292 (Administrative Code of 1987) provides for the continuing authority to the President to recognize the administrative structure of the Office of the President;

Executive Orders
Abolishing the Presidential Anti-Graft Commission and Transferring Its Investigative, Adjudicatory and Recommendatory Functions to the office of the Deputy Executive Secretary For Legal Affairs, office of the President
Executive Order No. 13
Declaration of Policy
Section 1: The government aims to fight and eradicate graft and corruption in government agencies. It also adopted a policy of streamlining the bureaucracy to promote efficiency.
Abolition of Presidential Anti-Graft Commission (PAGC)
Section 2: The PAGC is abolished, and its investigative, adjudicatory, and recommendatory functions are transferred to the Office of the Deputy Executive Secretary for Legal Affairs (ODESLA) in the Office of the President.
Restructuring of ODESLA
- Section 3: An Investigative and Adjudicatory Division will be created within ODESLA to perform the transferred functions from PAGC.
- The Deputy Executive Secretary for Legal Affairs will be the recommending authority to the President, through the Executive Secretary, for the approval, adoption, or modification of the reports and recommendations from the Investigative and Adjudicatory Division.
Personnel Affected by PAGC Abolition
Section 4: Personnel affected by the abolition of PAGC shall be allowed to avail benefits provided under existing laws, if applicable. The Department of Budget and Management is ordered to release necessary funds for employee benefits.
Winding Up of PAGC Operations
Section 5: The winding up of PAGC operations, including the final disposition or transfer of functions, positions, personnel, assets, and liabilities, shall be in accordance with the Rules and Regulations Implementing EO 72. The winding up shall be completed by December 31, 2010. The Office of the Executive Secretary, with the assistance of the Department of Budget and Management, shall ensure the smooth implementation of the winding-up activities.
Repealing Clause
Section 6: All executive orders, rules, regulations, and other issuances inconsistent with this Executive Order are revoked or modified accordingly.
Effectivity
Section 7: This Executive Order shall take effect immediately after its publication in a newspaper of general circulation.
