EXECUTIVE ORDER NO. 407 June 14, 1990

ACCELERATING THE ACQUISITION AND DISTRIBUTION OF AGRICULTURAL LANDS, PASTURE LANDS, FISHPONDS, AGRO-FORESTRY LANDS AND OTHER LANDS OF THE PUBLIC DOMAIN SUITABLE FOR AGRICULTURE

WHEREAS, Proclamation No. 131, S. of 1987, has instituted the Comprehensive Agrarian Reform Program to develop the full potential of Philippine agriculture that will result in increased productivity and better income for agrarian reform beneficiaries, and Executive Order No. 229, S. of 1987, has provided for the mechanisms for the implementation thereof;

WHEREAS, Republic Act No. 6657 has declared it a policy of the State to pursue the Comprehensive Agrarian Reform Program in order that the welfare of landless farmworkers will receive highest consideration and that the nation can move towards sound rural development and industrialization;

WHEREAS, Section 7 of Republic Act No. 6657 mandates, among others, that all lands foreclosed by government financial institutions, all lands acquired by the Presidential Commission on Good Government, and all other lands owned by the government devoted to or suitable for agriculture, shall...

- Mandates all government instrumentalities to immediately execute Deeds of Transfer in favor of the Republic of the Philippines, represented by the Department of Agrarian Reform (DAR), and surrender all landholdings suitable for agriculture, including ownership documents. (Section 1)
• Includes improvements, processing machineries, buildings, and other assets related to the landholdings. (Section 1)
• For lands with pending ownership adjudication, the government instrumentalities shall transfer physical possession and control to DAR when legally feasible. (Section 1)
• DAR shall commence activities for distribution to qualified beneficiaries upon receipt of documents or issue notice of allocation for usufructuary control if ownership cannot be transferred yet. (Section 1)
• Within 30 days of registration of ownership to DAR, the Land Bank of the Philippines shall pay the government instrumentality the value of the land, or DAR shall cause issuance of Credit Memo Advise for alternative payment schemes. (Section 1)
• Within 30 days of effectivity, the Department of Finance and Department of Budget and Management, in consultation with DAR, shall establish guidelines for the Credit Memo Advise System. (Section 1)
• Within 60 days of effectivity, the Land Registration Authority shall submit to DAR certified copies of all certificates of titles and survey plans under the name of the government instrumentality. (Section 1)

- Authorizes the Departments of Agriculture and Environment and Natural Resources to cancel lease agreements for fishponds, pasture, agro-forestry lands, and other public domain lands suitable for agriculture that have remained undeveloped within 3 years, underutilized, abandoned, or where terms and conditions have been violated, subject to due process. (Section 2)

- Directs the Departments of Agriculture and Environment and Natural Resources, in coordination with DAR, to redistribute and award cancelled or amended lease agreements for fishponds, pasture lands, and other public domain lands suitable for agriculture to qualified agrarian reform beneficiaries identified by DAR. (Section 3)

- Requires all concerned agencies to issue necessary directives and guidelines to their officials to ensure implementation of this Executive Order. (Section 4)

- Declares the Executive Order to take effect immediately. (Section 5)
