ADMINISTRATIVE ORDER NO. 15

AMENDING ADMINISTRATIVE ORDER NO. 233 (S. 2008) ENTITLED REITERATING THE PROHIBITION ON THE ACQUISITION AND USE OF LUXURY VEHICLES AND DIRECTING REVISIONS OF GUIDELINES ON GOVERNMENT MOTOR VEHICLES ACQUISITION

WHEREAS, this Administration recognizes the need to develop means and methods to promote transparency, efficiency and public accountability in the use of government resources;

WHEREAS, energy self-reliance and environmental protection necessitate the rationalization of petroleum consumption by government offices; and

WHEREAS, the process of acquiring new motor vehicles could be further streamlined thereby promoting efficiency and practicability.

NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

SECTION 1. Section 4.0 of Administrative Order (AO) No. 233 (s. 2008) is hereby amended to read as follows:

Summary of Administrative Order No. 15 Amending Administrative Order No. 233 (S. 2008)

Prohibition on Acquisition and Use of Luxury Vehicles:
- All government offices are directed to account for their motor vehicle units and prepare a disposal program for all luxury motor vehicles. (Section 1)
- A compliance report must be submitted to the Department of Budget and Management (DBM) and Office of the President (OP) within six (6) months. (Section 1)

Acquisition of Motor Vehicles by Local Government Units (LGUs):
- Local Chief Executives, including Punong Barangays, are authorized to approve the acquisition of specific types of motor vehicles enumerated under Section 7.0 using unencumbered local funds. (Section 2)
- For acquisitions using national government funds under the General Appropriations Act, LGUs must seek approval from the Secretary of Budget and Management for vehicles under Section 7.0 or the Secretary of the Interior and Local Government for other motor vehicles. (Section 2)

Approval Authority for Motor Vehicle Acquisitions:
- For departments, attached agencies, GOCCs, and GFIs:
- Evaluating and recommending authority is vested with DBM. (Section 3.1)
- Approving authority is vested with the department secretary concerned. (Section 3.1)
- For LGUs:
- Approving authority is vested with the Department of the Interior and Local Government (DILG). (Section 3.2)
- For other government offices/agencies:
- Evaluating and recommending authority is vested with DBM. (Section 3.3)
- Approving authority is vested with OP. (Section 3.3)

Implementing Guidelines:
- All motor vehicle acquisitions must comply with applicable budgetary, procurement, and auditing laws, regulations, and standards. (Section 4)
- OP, in coordination with DBM and DILG, is directed to provide necessary guidelines to effectively implement the provisions of this Order within sixty (60) days from effectivity. (Section 4)

Separability Clause and Repeal of Inconsistent Orders:
- If any provision is declared invalid or unconstitutional, the other unaffected provisions shall remain valid and subsisting. (Section 5)
- All orders or issuances inconsistent with this Administrative Order are hereby repealed or modified accordingly. (Section 6)

Effectivity:
- This Administrative Order shall take effect immediately. (Section 7)
