AMENDING EXECUTIVE ORDER (EO) NO. 500 DATED JANUARY 27, 2006, AND PROVIDING FOR THE EXPANSION OF AIR SERVICES TO THE DIOSDADO MACAPAGAL INTERNATIONAL AIRPORT (DMIA) AND SUBIC BAY INTERNATIONAL AIRPORT (SBIA)
WHEREAS, there is a need to amend certain provisions of Executive Order (EO) No. 500, dated 27 January 2006 in order to reflect accurately its legislative authority and to clearly delineate its territorial or jurisdictional coverage, type of services contemplated and the pre-conditions and requirements for its availability to foreign carriers;
WHEREAS, despite the urgency of putting in place all the components needed to fast-track the development of Diosdado Macapagal International Airport (DMIA) and the Subic Bay International Airport (SBIA), it is also equally important for the purpose of this objective to adopt more realistic timelines and proper phasing of activities;

Summary of Executive Order No. 500-A
Amending Executive Order No. 500 and Providing for the Expansion of Air Services to DMIA and SBIA
- Accurately reflects the legislative authority and territorial coverage of EO No. 500. (Section 1)
- Adopts realistic timelines and proper phasing of activities for the development of DMIA and SBIA. (Preamble)
Provisions:
- Declares the policy to accelerate the conversion of Clark and Subic military reservations into productive uses. (Section 1)
- Recognizes EO No. 253 providing for the expansion of air services to DMIA and SBIA. (Section 2)
- Civil Aeronautics Board (CAB) shall process applications for international passenger transportation services to DMIA and SBIA within 30 days, subject to the following: (Section 3)
- International passenger air access to DMIA and SBIA is declared as developmental. (Section 3a)
- Grants of civil aviation entitlements and air traffic access to DMIA and SBIA shall be geared towards their development as international gateways. (Section 3b)
- Considers the requirement for adequate, efficient, and reliable air links at competitive rates, and the increase in passenger and cargo traffic as a vital component of national interest. (Section 3c)
- Foreign air carriers designated by states with an Air Services Agreement (ASA) with the Philippines, but not granted specific rights to DMIA and SBIA, may apply for 3rd and 4th freedom traffic rights without restriction or limitation on capacity or type of aircraft. (Section 3d)
- Upon application, CAB shall lift limitations on 3rd and 4th freedoms and type of aircraft for foreign air carriers already designated to DMIA and SBIA under existing ASAs. (Section 3e)
- Foreign carriers from states with an ASA with the Philippines, but not designated to any Philippine destination, may avail of unlimited 3rd and 4th freedom traffic rights to DMIA and SBIA, provided they are officially designated by their respective countries. (Section 3f)
- Other forms of air traffic rights beyond the 4th air freedom, except cabotage, may be subject to application by any foreign carrier, following required processes and evaluated by CAB in the context of national interest. (Section 3g)
- The Philippine Air Negotiating Panel is directed to initiate Air Consultation Talks with Singapore, Malaysia, Thailand, and the Republic of Korea within 20 months to formalize Special Charter Permits granted by CAB into permanent entitlements, ensuring continuity of flights and development of the Clark-Subic area as an international gateway and aviation service and logistics center. (Section 4)
- Supersedes or amends inconsistent orders, circulars, memoranda, rules, regulations, and other issuances. (Section 5)
- Takes effect immediately following publication in a newspaper of general circulation. (Section 6)
