Case Overview and Summary
Summary of Executive Order No. 1027 Amending Executive Order No. 1012Operational Supervision and Direction of Integrated National Police (INP):
- The operational supervision and direction exercised by the Philippine Constabulary/INP over INP units is transferred to city or municipal governments, until further orders from the President. (Sec. 1)
- The President can terminate the authority of local executives to exercise operational supervision and direction over INP units if the power is abused or when exigencies require it. (Sec. 1)
- The INP shall function under the command, general supervision, and control of the President, who may authorize local executives to exercise general supervision over INP units. (Sec. 1)
- The President exercises administrative supervision and control over all INP units. (Sec. 1)
Inventory and Reassignment of INP Members:
- Provincial Governors, in coordination with Provincial Commanders/Superintendents, shall conduct an inventory of all INP members in each municipality and city within the province to determine their number and residences. (Sec. 2)
- In highly urbanized cities, the inventory shall be undertaken by City Mayors in coordination with INP Commanders. (Sec. 2)
- In Metropolitan Manila, the inventory shall be conducted by City/Municipal Mayors in coordination with INP Station Commanders/Superintendents, and reported to the Metropolitan Manila Governor and Commanding General, PC Metropolitan Command/Director, Metropolitan Police Force. (Sec. 2)
- After the inventory, the Metropolitan Manila Governor or Provincial Governors and Municipal/City Mayors, in coordination with the respective INP commanders, shall reassign and redistribute INP members based on: (a) population, (b) peace and order situation, and (c) financial contribution to INP. (Sec. 3)
- INP members shall be assigned to their municipality or city of residence, and if necessary, augmented by assigning members from other municipalities/cities within the area. (Sec. 3)
- The Metropolitan Manila Governor, upon recommendations of Municipal/City Mayors, may transfer and reassign Chiefs of Police, Station Commanders/Superintendents, or equivalent commands within Metropolitan Manila, with the President's approval. (Sec. 3)
- Other police officers may be transferred or reassigned to other stations without the President's approval. (Sec. 3)
Reassignment and Appointment of INP Members:
- No further reassignment or detail of INP members outside their respective towns and cities of residence shall be made without the approval of the Municipal or City Mayor concerned. (Sec. 4)
- No appointment of new INP members in any municipality or city shall be made, except upon the approval of the Municipal or City Mayor therein. New appointees shall generally be residents of the assigned city or municipality. (Sec. 4)
- If there is a need to augment the police force in any municipality or city, it may be done by reassigning INP members who are residents of other municipalities/cities within the area in consultation with local executives, or by new appointments subject to the approval of the Municipal or City Mayor concerned. (Sec. 5)
- The reassignment of INP members to municipalities and cities other than their places of residence shall be done on a rotation basis and in consultation with local executives. (Sec. 6)
Conflict Resolution:
- In case of conflict between a local executive and an INP Station Commander regarding the implementation of this Order, particularly with respect to normal police operations, the stand of the local executive shall generally prevail. (Sec. 7)
- In case of an irreconcilable disagreement, the matter may be brought to the Provincial Governor for resolution. If the resolution is against the position of the INP Station Commander, the latter may elevate the case to the Minister of National Defense, who shall resolve it in consultation with the Minister of Local Government. If the resolution is against the position of the local executive, the latter may elevate the case to the Minister of Local Government, who shall resolve it in consultation with the Minister of National Defense. (Sec. 7)
- If there is an irreconcilable disagreement between the Minister of National Defense and the Minister of Local Government, the case shall be elevated to the President for final resolution. (Sec. 7)
- In Metropolitan Manila, any irreconcilable disagreement between a local executive and a Station Commander/Superintendent shall be elevated to the Metropolitan Manila Governor or authorized representative for resolution. Any party not satisfied with the resolution may appeal to the President, with the INP Station Commander/Superintendent coursing the appeal through appropriate INP command channels. (Sec. 7)
Disciplinary Powers of Local Executives:
- City and Municipal Mayors, concurrently with the designated Station Commanders or equivalent commands, after due notice and hearing, shall have the power to impose disciplinary penalties for minor offenses committed by INP members assigned to their respective jurisdictions, through: (a) admonition or reprimand, (b) restriction to specified limits, (c) withholding of privileges, (d) forfeiture of salary for not more than ten (10) days, (e) suspension for not exceeding ten (10) days, or any combination thereof. (Sec. 8)
- City and Municipal Mayors may impose a period of forfeiture of salary and/or suspension longer than ten (10) days but no longer than thirty (30) days. (Sec. 8)

EXECUTIVE ORDER NO. 1027 May 14, 1985
AMENDING EXECUTIVE ORDER NO. 1012
WHEREAS, there is a need to clarify the provisions of Executive Order No. 1012 insofar as general and administrative supervision and control over Integrated National Police forces are concerned;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and by law, do hereby order:
Sec. 1. Section 1 of Executive Order No. 1012 is hereby amended to read as follows:
"Sec. 1. The provisions of special or general laws to the contrary notwithstanding, the operational supervision and direction exercised by the Philippine Constabulary/Integrated National Police (PC/INP) over all units of the Integrated National Police force stationed or assigned in the different cities and municipalities all over the country, is hereby transferred to the city or municipal governments concerned, until further orders from the President of the Philippines. The term `Operational Supervision and Direction' shall be as defined in Section 1(e) of Presidential Decree No. 1162.
