EXECUTIVE ORDER NO. 125-A April 13, 1987
AMENDING EXECUTIVE ORDER NO. 125, ENTITLED "REORGANIZING THE MINISTRY OF TRANSPORTATION AND COMMUNICATIONS. DEFINING ITS POWERS AND FUNCTIONS, AND FOR OTHER PURPOSES."
WHEREAS, considering the peculiar situation obtaining in the Department of Transportation and Communications (DOTC), there is a compelling need to clarify and/or modify structural and functional organization of the Department as provided under Executive Order No. 125 in order to ensure compliance with its mandate and the attainment of the corresponding objectives as specified in Section 4 of said Executive Order.
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order:
Sec. 1. Sections 5, 8, 9, 10 and 11 of Executive Order No. 125, otherwise known as the Reorganization Act of the Ministry of Transportation and Communications, are hereby amended to read as follows:

Amending Executive Order No. 125, Reorganizing the Ministry of Transportation and Communications
Powers and Functions of the Department (Section 5):
- Formulate national policies and guidelines for transportation and communications systems.
- Establish and administer comprehensive programs for transportation and communications.
- Assess and review transportation and communication research and development programs.
- Administer and enforce laws, rules, and regulations in transportation and communications.
- Coordinate with the Department of Public Works and Highways for infrastructure projects.
- Establish, operate, and maintain a nationwide postal system.
- Issue certificates of public convenience for public land and rail transportation utilities.
- Accredit foreign aircraft manufacturers and international organizations for aircraft certification.
- Establish rules and regulations for routes, zones, and areas of operation for public land services.
- Establish rules and regulations for telecommunications facilities in underserved areas.
- Establish rules and regulations for the nationwide postal system.
- Establish rules and regulations for certificates of public convenience for public land transportation utilities.
- Establish rules and regulations for inspection and registration of air and land transportation facilities.
- Establish rules and regulations for licenses to motor vehicle drivers, conductors, and airmen.
- Establish rules and regulations for enforcement of laws governing land transportation, air transportation, and postal services.
- Determine, fix, and prescribe charges and rates for public air and land transportation utility facilities and services.
- Establish rules and regulations for accreditation of driving schools.
- Administer and operate the Civil Aviation Training Center and National Telecommunications Training Institute.
- Perform other powers and functions as prescribed by law or assigned by the President.
Undersecretaries (Section 8):
- The Secretary shall be assisted by four (4) Undersecretaries appointed by the President.
Assistant Secretaries and Service Chiefs (Section 9):
- The Secretary shall be assisted by eight (8) Assistant Secretaries appointed by the President.
- Each Assistant Secretary shall be responsible for specific staff offices and line offices.
- Each service shall be headed by a service chief appointed by the President.
Structural Organization (Section 10):
- The Department shall include the Department proper, regional offices, and attached agencies and corporations.
- The Office of the Secretary shall have direct supervision and control over the regional offices.
- The Department proper shall be responsible for developing and implementing policies, plans, programs, and projects.
Department Regional Offices (Section 11):
- There shall be three (3) Department Regional Offices in each administrative region: Land Transportation, Telecommunications, and Postal Services.
- Each Department Regional Office shall be headed by a Regional Director and Assistant Regional Director.
- The Regional Offices shall be responsible for the delivery of front-line services of the Department.
- Functions of the Regional Offices include implementing laws, policies, plans, programs, and projects; providing efficient and effective service; coordinating with other agencies and local government units; and performing other functions as provided by law.
Maritime Industry Authority (Section 12):
- The Maritime Industry Authority is retained and shall have various functions related to the maritime industry, including developing plans and policies, establishing routes and zones of operation, issuing certificates of public convenience, registering vessels, enforcing laws and regulations, determining charges and rates, accrediting maritime enterprises, and performing other related functions.
Abolition/Transfer/Consolidation (Section 13):
- The Land Transportation Commission is abolished, and its staff functions are transferred to the Department Proper, while its line functions are transferred to the Department Regional Offices for Land Transportation.
- PNL Leasing, Inc. is abolished, and its functions are transferred to Philippine National Lines, Inc.
- The National Aero Manufacturing, Inc. and the Philippine Aero Systems, Inc. are abolished.
- The Civil Aeronautics Board is transferred from the Department of Tourism to the Department as an attached agency.
- The Maritime Training Council's function of issuing certificates of competency to seamen is transferred to the Maritime Industry Authority.
Repealing Clause (Section 23):
- Presidential Decree No. 890, Letter of Instruction Nos. 263 and 371, and Executive Order No. 1011 are repealed.
- All laws, ordinances, rules, regulations, and other issuances inconsistent with this Executive Order are repealed or modified accordingly.
