AMENDING EXECUTIVE ORDER NO. 868 WHICH REORGANIZED THE BOARD OF REVIEW FOR MOTION PICTURES AND TELEVISION
WHEREAS, Executive Order No. 868 reorganized the Board of Review for Motion Pictures and Television, and expanded its powers and functions as well as its field of supervision and regulation to include, among others, live entertainment, video tapes and similar media;
WHEREAS, in view of the representations of certain sectors of the motion picture and television industries, and the difficulty of implementing the original intent of Executive Order No. 868, there is a need to limit the scope of the powers and functions of the Board;
WHEREAS, industries related to motion picture and television shall be accordingly attended to either by a separate Executive Order or by a Batas Pambansa;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution and by Presidential Decree No. 1416, as amended by Presidential Decree No. 1772, do hereby order:

Board of Review for Motion Pictures and Television
- Created under the Office of the President of the Philippines (Sec. 1)
- Composed of a Chairman, two Vice-Chairmen, and 32 members appointed by the President for 4-year terms (Sec. 2)
- Qualifications: natural-born Filipino citizen, at least 30 years old, good moral character, not connected with motion picture or television industry (Sec. 2)
Functions, Powers, and Duties of the Board (Sec. 3)
- Promulgate rules and regulations for implementing Republic Act No. 3060 (as amended)
- Screen, review, and examine all motion pictures and publicity materials, whether for theatrical, non-theatrical, television broadcast, or general viewing, imported or produced in the Philippines
- Approve, disapprove, delete objectionable portions, or prohibit importation, exportation, production, copying, distribution, sale, lease, exhibition, and/or television broadcast of motion pictures and publicity materials based on contemporary Filipino cultural values, such as:
- Inciting subversion, insurrection, or rebellion (Sec. 3(c)(i))
- Undermining faith and confidence in the government (Sec. 3(c)(ii))
- Glorifying criminals or condoning crimes (Sec. 3(c)(iii))
- Satisfying the market for violence or pornography (Sec. 3(c)(iv))
- Offending any race or religion (Sec. 3(c)(v))
- Abetting the traffic in and use of prohibited drugs (Sec. 3(c)(vi))
- Supervise, regulate, and grant, deny or cancel permits for importation, exportation, production, copying, distribution, sale, lease, exhibition, and/or television broadcast of motion pictures and publicity materials
- Classify motion pictures, television programs, and similar shows into categories such as "For General Patronage" and "For Adults Only" (Sec. 3(e))
- Regulate, supervise, and grant, deny or cancel permits for the operation of cinema houses, theaters, and other establishments engaged in public exhibition of motion pictures (Sec. 3(f))
- Levy, assess, collect, and periodically adjust fees and charges for review and examination work, and issuance of licenses and permits (Sec. 3(g))
- Deputize representatives from government and private sectors to ensure compliance with laws related to motion pictures and television (Sec. 3(h))
- Cause prosecution of violators of this Act, anti-trust, obscenity, and other pertinent laws (Sec. 3(i))
- Prescribe internal and operational procedures for exercising powers and functions (Sec. 3(j))
- Exercise other necessary powers and functions, and perform other related duties as directed by the President (Sec. 3(k))
Definitions (Sec. 4)
- Motion Picture: A series of pictures projected on a screen to produce the optical effect of continuous motion, including films, reels, cassettes, and discs (Sec. 10(1))
- Television Broadcast: Public showing by transmitting sound or images by television or similar equipment, including cable television (Sec. 10(2))
- General Viewing: Making motion pictures available to the general public through film packs, cassettes, discs, or similar materials sold, leased, or lent in commercial outlets, public lending clubs, and similar organizations (Sec. 10(3))
- Non-Theatrical Distribution: Public showing of motion pictures through mobile projection equipment without admission fee, showing to organizations, societies, clubs, groups, etc., and showing of educational, documentary, cultural, scientific, newsreel, industrial, sales, public relations, and instructional films (Sec. 10(4))
- Theatrical Distribution: Public showing and/or exhibition of motion pictures in cinema houses, theaters, or any other place imposing admission fees for entertainment, education, information, and advertising (Sec. 10(4))
- Adult: Any person 18 years of age or over (Sec. 10(d))
- Review Session: Review and examination of motion pictures, television programs, similar shows, or publicity materials by the Board (Sec. 10(e))
Enforcement and Penalties (Sec. 5)
- The Board or its authorized representatives have the power to inspect public exhibitions of motion pictures or publicity materials in cinema houses, theaters, and other public establishments
- If any previously approved material has been tampered with to introduce unapproved matter, the Board can immediately seize the unapproved matter and cause prosecution of the violator(s)
- Upon conviction, the seized materials and other proceeds or instruments of the crime shall be disposed of in accordance with the Revised Penal Code (as amended)
Effective Date (Sec. 6)
- This Executive Order shall take effect 15 days after its publication in newspapers of general circulation in the Philippines.
