EXECUTIVE ORDER NO. 952 May 4, 1984
AMENDING EXECUTIVE ORDERS NO. 537 AND NO. 823, AND FOR OTHER PURPOSES
WHEREAS, under Presidential Decree No. 1416, as amended, the President is empowered to undertake such organizations changes as may be necessary in the light of changing circumstances and developments;
WHEREAS, as a result of its increased role, functions and responsibilities, the Secretariat of the Garment and Textiles Export Board (GTEB) has to be revitalized and given incentives;
WHEREAS, under Section 7 of Executive Order No. 823, the GTEB has been declared a critical government agency pursuant to P.D. 985;
WHEREAS, there is a need to amend Section 7 of Executive Order No. 823 in order to strengthen the intent of said Section and to implement the same without the need of any other act or order;
WHEREAS, the powers and functions of the GTEB have to be clarified with respect to imports of goods and exports of garments;

Summary of Executive Order No. 952
Amendments to Executive Orders No. 537 and No. 823
- Section 3 of EO 537 amended to clarify powers of Garment and Textiles Export Board (GTEB):
• Negotiate and implement garment and textile agreements with other countries (Sec. 1a)
• Approve quota allocations, export authorizations, issue export licenses for textiles and garments (Sec. 1a)
• Cancel or suspend quota allocations, export authorizations, disqualify firms for violations (Sec. 1h)
• Impose fines up to P0.50 per square yard for unutilized allocations, up to 10% of FOB value for violations (Sec. 1i)
- Section 4 of EO 537 amended regarding GTEB Secretariat:
• Headed by Executive Director and two Deputy Executive Directors appointed by President (Sec. 2)
• Exempt from OCPC rules and regulations (Sec. 2)
- Section 5 of EO 537 amended regarding powers of GTEB Chairman:
• Exercise direct supervision and control over Executive Director, Deputies, and Secretariat (Sec. 3)
• Appoint and discipline Secretariat personnel, subject to Board confirmation (Sec. 3)
• Approve agenda, convene and preside over Board meetings (Sec. 3)
- Section 7 of EO 823 amended regarding GTEB as critical agency:
• GTEB declared critical agency under PD 985 (Sec. 4)
• Income from fees, fines, penalties deemed corporate income (Sec. 4)
• Can maintain separate account and use income for financial incentives, expenses with President's approval (Sec. 4)
- Repealing and separability clauses included (Sec. 5-6)
- Immediate effectivity (Sec. 7)
