EXECUTIVE ORDER NO. 770 December 1, 2008

AMENDING LETTER OF INSTRUCTION (LOI) 1350 OTHERWISE KNOWN AS "PROVIDING THE INSTITUTIONAL FRAMEWORK FOR NATIONAL PHYSICAL PLANNING"

WHEREAS, LOI 1350 institutionalized land use and physical planning in the country and created the National Land Use Committee (NLUC) on 02 August 1983;

WHEREAS, there is a need to amend LOI 1350 to strengthen the NLUC by elevating it into a National Economic and Development Authority (NEDA) Board Committee;

WHEREAS, the NLUC, as a NEDA Board Committee, can advise the President and the NEDA Board on all matters concerning land use and physical planning; and decide and resolve land use policy conflicts between or among national government agencies;

WHEREAS, there is a need to provide for rational utilization and management of the country’s land and other physical resources to ensure their optimum use consistent with the principles of sustainable development;

Summary of Executive Order No. 770

Strengthening the National Land Use Committee (NLUC)
- Elevates the NLUC into a National Economic and Development Authority (NEDA) Board Committee, making it the highest policy-making body on land use. (Section 1)
- Reconstitutes the composition of the NLUC to include various government agencies and private sector representatives. (Section 2)

Functions of the NEDA Board-NLUC
- Advise the President on matters concerning land use and physical planning. (Section 3a)
- Formulate a national physical framework plan and other inter-sectoral policies and programs for rational utilization and management of land and physical resources. (Section 3b)
- Promote integration of land use, physical planning, and disaster risk management policies into national socio-economic plans. (Section 3c)
- Decide and resolve land use policy conflicts among national government agencies. (Section 3d)
- Establish and maintain a database system for identifying and classifying land uses. (Section 3e)
- Provide policy directions to Regional Land Use Committees. (Section 3f)

Creation of the NLUC Technical Board
- A Technical Board shall be created to provide technical support to the NEDA Board-NLUC. (Section 4)
- The Technical Board shall be composed of representatives from member-agencies of the NEDA Board-NLUC, with a rank not lower than Director level. (Section 5)

Institutionalization of Regional Land Use Committees (RLUCs)
- RLUCs under the Regional Development Council will be strengthened, with a composition replicating the NEDA Board-NLUC. (Section 6)
- Functions of RLUCs include: (Section 6)
    - Formulate and update Regional Physical Framework Plans.
    - Promote integration of land use, physical planning, and disaster risk management policies into regional socio-economic plans.
    - Decide and resolve region-specific land use policy conflicts among government agencies.
    - Review and recommend actions to the NEDA Board-NLUC on land use policy conflicts between national government agencies.
    - Assess changes in land use and physical resources, and implementation of Regional Physical Framework Plan policies.
    - Evaluate consistency of major programs and projects with the Regional Physical Framework Plan and their impact on land use and environment.
    - Gather, update, and maintain a regional database system.
    - Perform other functions as directed by the NEDA Board-NLUC.

Other Provisions
- The NEDA Board-NLUC may call on any government agency or private entity for cooperation, support, and assistance. (Section 7)
- Funds needed for the first calendar year shall be drawn from the current NLUC funds under the NEDA budget. Thereafter, additional funds shall be included in the General Appropriations Act. (Section 8)
- The Secretary of Socio-Economic Planning shall issue implementing rules and regulations for efficient and effective implementation of the Executive Order. (Section 9)
- All previous issuances inconsistent with this Executive Order are repealed or modified accordingly. (Section 10)
- The Executive Order shall take effect immediately after its publication in the Official Gazette or a newspaper of general circulation. (Section 11)
