AMENDING PRESIDENTIAL DECREE NO. 3 ENTITLED APPROPRIATING FUNDS FOR PUBLIC WORKS, INVOLVING REHABILITATION AND CAPITAL DEVELOPMENT, SYNCHRONIZING THE SAME WITH THE PREVIOUS PUBLIC WORKS APPROPRIATIONS
I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution as Commander-in-Chief of all the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081, dated September 21, 1972, do hereby decree, order and make as part of the law of the land the following measure:
Section 1. Section 7 of the Presidential Decree No. 3 dated September 26, 1972, is hereby amended as follows:
"Sec. 7. The National Economic Development Authority (N.E.D.A.) shall formulate and issue rules and regulations designed to accelerate implementation or prosecution of public works projects, including the manner of, and priority in, expenditures of funds or the allocation thereof, either by the national or local governments, or by any other agency of the government, the necessity of bidding or...

Amending Presidential Decree No. 3 on Appropriating Funds for Public Works
- Empowers the National Economic Development Authority (NEDA) to formulate rules and regulations for:
• Accelerating implementation of public works projects (Section 1)
• Determining manner and priority of expenditures or fund allocation for public works projects by national, local governments, or other agencies (Section 1)
• Determining necessity of bidding or when it can be dispensed with (Section 1)
• Organizing a Council or agency to effectively prosecute infrastructure and other government programs, and prescribing its powers and functions (Section 1)
- Until NEDA promulgates such rules and regulations:
• Public works projects costing P200,000 or less may be done by administration without public bidding, subject to Section 14 (Section 1)
• Public works projects costing more than P200,000 shall be awarded by contract after public bidding (Section 1)
• If no responsible bids, bids are higher than government estimate, or project can be prosecuted by administration, it may be done by administration after approval of Department Head (Section 1)
• In case of urgent necessity or emergency, projects may be prosecuted by administration without public bidding upon representation by bureau or agency, subject to recommendation of Department Head and approval of the President (Section 1)
- The Decree takes effect immediately (Section 2)
