Presidential Decree No. 1304
February 24, 1978
Case Overview and Summary
Presidential Decree No. 1304 Amending Section 2 of Presidential Decree No. 967- Rationale and Background:
• Section 2 of Presidential Decree No. 967 amended Section 8 of Republic Act No. 477 to remove restrictions on alienation, encumbrance, or disposition of lands acquired under R.A. No. 477, effectively transferring full ownership to awardees. (Section 1)
• However, the amendment could not be applied to transfers made before July 24, 1976, when P.D. No. 967 took effect, leading to speculative litigations and actions affecting ownership. (Preambulatory Clause)
- Key Provisions:
• Section 8 of R.A. No. 477 is further amended to state that any provision of law, executive order, rules, or regulations notwithstanding, an applicant who acquired land under R.A. No. 477 and has a certificate of title may sell, cede, transfer, or convey their rights and interests, including permanent improvements. (Section 1)
• All previous sales, transfers, conveyances, and encumbrances regarding such lands and permanent improvements made and consummated before July 24, 1976, are confirmed, ratified, and validated. (Section 1)
- Repealing Clause and Effectivity:
• All laws, decrees, executive orders, rules, and regulations inconsistent or conflicting with this Decree are repealed or modified accordingly. (Section 2)
• This Decree takes effect immediately. (Section 3)
