EXECUTIVE ORDER NO. 213 July 10, 1987
AMENDING THE DEFINITION OF "BULK CONTAINERS" FOR MILK IMPORTS AS PROVIDED FOR IN EXECUTIVE ORDER NO. 49
WHEREAS, it is the intent under Executive Order No. 49 to grant a lower tariff (10% ad valorem) to milk imported in bulk containers (20%) ad valorem);
WHEREAS, milk imported in bulk containers is defined under Executive Order No. 49 as having a gross weight of at least 25 kgs., the standard unit of packing of the country's traditional suppliers such as Europe, Australia and New Zealand;
WHEREAS, present Philippine standards on radioactive contamination require the milk industry to look for alternative sources of supply of milk such as the United States, whose standard unit of packing is 50 lbs. or about 22.7 kgs.;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:
Sec. 1. The definition of "bulk containers" for milk imports as provided in Executive Order No. 49 is hereby amended to read as follows:

Definition of "Bulk Containers" for Milk Imports
- Amends the definition of "bulk containers" for milk imports under Executive Order No. 49. (Section 1)
- For milk imports under CCCN Heading No. 04.02, "bulk containers" are now defined as having a gross weight of 20 kgs. or more. (Section 1)
- This change in definition is to accommodate imports from the United States, whose standard unit of packing is 50 lbs. or about 22.7 kgs. (Whereas clause)
Tariff Rates
- Milk imports in "bulk containers" (gross weight of 20 kgs. or more) under CCCN Heading No. 04.02 are subject to an import duty rate of 10% ad valorem. (Section 1)
- The tariff rates and classifications for other articles under Executive Order No. 49 remain in effect if not affected by Section 1. (Section 3)
Effectivity
- The amended tariff rate for milk imports in "bulk containers" shall apply to entries or withdrawals from warehouses in the Philippines for consumption upon the effectivity of this Executive Order. (Section 2)
- This Executive Order takes effect immediately. (Section 5)
Repealing Clause
- All laws, orders, issuances, rules, and regulations inconsistent with this Executive Order are repealed or modified accordingly. (Section 4)AIC Grande Tower Garnet Road
