AN ACT AMENDING REPUBLIC ACT NO. 5412, AS AMENDED, OTHERWISE KNOWN AS THE CHARTER OF THE CITY OF GENERAL SANTOS
Be it enacted by the Senate and House of Representative of the Philippines in Congress assembled:
Section 1. Sections 98 and 101 of Republic Act No. 5412, as amended, are hereby further amended to read as follows:
"Section 98. All lands of the public domain having been ceded by the national government to the City of General Santos, the city shall exercise the rights and prerogatives over such lands in the concept of a beneficial owner. Amendments to the Charter of the City of General Santos
- Land Ownership and Management (Section 98)
• The city shall exercise rights and prerogatives over public lands ceded to it as a beneficial owner.
• Disposition of public lands shall follow Commonwealth Act No. 141 and other relevant laws. (Section 98)
• All income from disposition, administration, and management of public lands shall accrue exclusively to the city. (Section 98)
• The city government shall be consulted and informed on the disposition, administration, and management of public lands. (Section 98)
• The city government shall concur prior to any disposition, administration, and management of public lands. (Section 98)
- Ownership of Public Utilities and Infrastructure (Section 101)
• The city shall own all existing waterworks, electric light and power, telephone systems, roads, streets, bridges, docks, piers, wharves, machinery, equipment, and other public works improvements. (Section 101)
• The city shall own the funds and assets of the former Municipality of General Santos and assume its liabilities. (Section 101)
• The city government shall be informed and its concurrence shall be sought on all matters relating to lands by concerned government agencies, as determined by the city council. (Section 101)
- Establishment and Operation of Gambling (Section 101-A)
• Any form of gambling authorized under existing laws, such as Presidential Decree Nos. 420, 1869, and Republic Act No. 1169, shall not be allowed except upon prior concurrence of the City Government of General Santos. (Section 101-A)
- Reporting of Public Land Dispositions (Section 3)
• Within 60 days from the effectivity of this Act, all concerned government agencies shall submit a comprehensive and detailed report of all dispositions of public lands in the city to the City Government. (Section 3)
- Penalties (Section 5)
• Any person who violates the provisions of this Act shall suffer 6 months imprisonment and, if a government official or personnel, perpetual disqualification from holding public office, in addition to other liabilities. (Section 5)
- Implementation (Section 8)
• The City Council of General Santos City, in coordination with concerned government agencies, shall promulgate the necessary implementing rules and regulations within 60 days from the effectivity of this Act. (Section 8)
- Effectivity (Section 9)
• This Act shall take effect 15 days from its publication in at least two newspapers of national circulation. (Section 9)
