AN ACT AMENDING REPUBLIC ACT NO. 8182, AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled::

Section 1. Republic Act No. 8182 is hereby amended to include a new Sec. 11-A to read as follows:

"Sec. 11-A. In the contracting of any loan, credit or indebtedness under this Act or any law, the President of the Philippines may, when necessary, agree to waive or modify the application of any provision of law granting preferences in connection with, or imposing restrictions on, the procurement of goods or services: Provided, however, That as far as practicable, utilization of the services of qualified Filipino citizens or corporations or associations owned by such citizens in the prosecution of projects financed under this Act shall be prepared on the basis of the standards set for a particular project: Provided, further, That the matter of preference in favor...

Amendments to Republic Act No. 8182

• Allows the President to waive or modify laws granting preferences or imposing restrictions on procurement of goods or services when contracting loans or credits (Section 1, Sec. 11-A)
    - Utilization of services of qualified Filipino citizens or corporations shall be preferred, as far as practicable.
    - Preference for Philippine-made articles, materials, or supplies shall be subject to agreement with the lending institution.

• Proceeds of Official Development Assistance (ODA) shall be used for equitable growth and development in all provinces through priority development projects (Section 2, Sec. 4)
    - Rural infrastructure, countryside development, and economic zones shall be given preference.
    - 5% of the total ODA loan from the preceding year shall be obtained for project identification, feasibility studies, master planning, and monitoring and evaluation.
    - ODA shall not be used for:
        a) Telephone programs contracted as of January 1, 1996, except for basic telephone programs and projects for rural areas not adequately serviced.
        b) Projects mandated by law to be served by the private sector.
        c) Financing for private corporations with access to commercial credit.
    - ODA shall be for previously identified national priority projects that are urgent or necessary.

• The Act shall take effect 5 days after publication in the Official Gazette or in at least two national newspapers of general circulation, whichever comes first (Section 3).
