Summary of Republic Act No. 9397Disposition of Lands for Socialized Housing
- The National Housing Authority (NHA) and local government units (LGUs) shall coordinate to formulate schemes for disposition of lands to beneficiaries of the socialized housing program. (Section 1)
- Schemes are not limited to transfer of ownership but can include lease, usufruct, or other variations deemed expedient by NHA or LGUs. (Section 1)
- A public rental housing scheme may be adopted. (Section 1)
- Direct negotiated sale of government-owned lands to occupants without public bidding is allowed under the following conditions:
    - Lands are within a residential zone classified by the LGU. (Section 1(a))
    - Lands are certified for socialized housing by the Housing and Urban Development Coordinating Council. (Section 1(b))
    - Occupants are qualified beneficiaries registered under Sections 16 and 17 of the Act. (Section 1(c))
    - Cost of lands is made affordable based on beneficiaries' income and land valuation under Section 13. (Section 1(d))
    - Subsequent disposition of lands is subject to limitations in Section 14. (Section 1(e))
    - Occupants have resided on the lands, subject to prohibitions in Section 30. (Section 1(f))
- Separability clause: If any part is held unconstitutional, other provisions remain in effect. (Section 2)
- Repealing clause: Inconsistent laws, decrees, orders, rules, and regulations are repealed, amended, or modified accordingly. (Section 3)
- Effectivity: The Act takes effect 15 days after publication in at least two newspapers of general circulation. (Section 4)

AN ACT AMENDING SECTION 12 OF REPUBLIC ACT NO. 7279, OTHERWISE KNOWN AS THE URBAN DEVELOPMENT AND HOUSING ACT OF 1992, AND FOR OTHER PURPOSES
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Section 12 of Republic Act No. 7279, otherwise known as the "Urban Development and Housing Act of 1992," is hereby amended to read as follows:
"SEC. 12. Disposition of Lands for Socialized Housing. - The National Housing Authority, with respect to lands belonging to the National Government, and the local government units with respect to the other lands within their respective localities, shall coordinate with each other to formulate and make available various alternative schemes for the disposition of lands to the beneficiaries of the Program.
