Summary of Republic Act No. 11312Strengthening the Magna Carta for Scientists, Engineers, Researchers and Other Science and Technology Personnel in the Government
- Honorarium (Section 1)
• Science and technology (S&T) personnel who rendered services beyond regular workload and contributed to productivity and innovativeness shall receive honorarium, subject to rules set by the Department.
• No limit on additional honoraria from externally funded grants for S&T personnel. (Section 1a)
- Non-DOST S&T Personnel (Section 2)
• S&T personnel not employed by DOST but involved in scientific and technological activities (STA) may avail benefits upon certification by agency head.
• Agency heads shall follow DOST guidelines for certification and entitlement. (Section 8)
- Hiring of Retired Scientists and Technical Personnel (Section 3)
• Retired employees with technical qualifications may be rehired on contract without refunding benefits, if no qualified expert is available. (Section 16)
• Services of scientists due for compulsory retirement may be extended up to 5 years, subject to conditions like project priority, fitness, and Civil Service Commission approval at least 3 months prior. (Section 16)
• Extension period shall be credited as government service with leave credits and other benefits. (Section 16)
- Separability Clause (Section 4)
• If any provision is declared invalid or unconstitutional, remaining provisions shall remain valid and effective.
- Repealing Clause (Section 5)
• Inconsistent laws, decrees, orders, and issuances are repealed, amended or modified accordingly.
- Effectivity (Section 6)
• The Act shall take effect 15 days after publication in the Official Gazette or two newspapers of general circulation.

REPUBLIC ACT NO. 11312
AN ACT STRENGTHENING THE MAGNA CARTA FOR SCIENTISTS, ENGINEERS, RESEARCHERS AND OTHER SCIENCE AND TECHNOLOGY PERSONNEL IN THE GOVERNMENT, AMENDING FOR THE PURPOSE REPUBLIC ACT NO. 8439
SECTION 1. Section 7 of Republic Act No. 8439 is hereby amended to read as follows:
"SEC. 7. Other Benefits. — Notwithstanding laws and issuances on Compensation and Position Classification System, and Salary Standardization in the Government, science and technology personnel defined under Section 5 of Republic Act No. 8439 shall receive the following:
"(a) Honorarium. — S & T personnel who rendered services beyond the established regular workload of scientists, technologists, researchers and technicians whose broad and superior knowledge, expertise or professional standing in a specific field contributes to productivity and innovativeness shall be entitled to receive honorarium subject to rules to be set by the Department. CAIHTE
"The government shall not impose a limit on the amount of additional honoraria sourced from externally funded grants that may be received by S & T personnel.
