Summary of Republic Act No. 21

Authorizing Payment of Claims to Parents of Minors or Incompetents
- Any legitimate father, or in his absence, the mother, can receive payment for a claim or share in a claim against the Philippine or U.S. government on behalf of their minor or incompetent child/dependent without being appointed as a legal guardian, subject to the following conditions:
    - The claim amount does not exceed 500 pesos or its equivalent in dollars. (Section 1)
    - The parent is not an "imbecile, insane, vagrant or vicious person, or a habitual drunkard or habitual criminal." (Section 1)
    - The parent has not abandoned, neglected, refused to support, or caused the minor/incompetent to commit offenses against the law. (Section 1)

Effective Date
- The Act took effect upon its approval on September 25, 1946. (Section 2)

Republic Act No. 21 &nbsp &nbsp &nbsp &nbsp &nbsp &nbsp September 25, 1946 AN ACT AUTHORIZING THE LEGITIMATE FATHER, OR, IN HIS DEFAULT, THE MOTHER, OF ANY MINOR OR INCOMPETENT PERSON HAVING A CLAIM OR SHARE IN A CLAIM AGAINST THE GOVERNMENT OF THE PHILIPPINES OR OF THE UNITED STATES, TO RECEIVE PAYMENT OF SAID CLAIM OR SHARE WHEN THE AMOUNT THEREOF DOES NOT EXCEED FIVE HUNDRED PESOS OR ITS EQUIVALENT IN DOLLARS Section 1. Any provision of law to the contrary notwithstanding, the legitimate father, or, in his default, the mother, of any minor or incompetent person having a claim, or share in a claim, against the Government of the Philippines or of the United States, is authorized, without need of the court appointing him or her as guardian for said minor or incompetent person, to receive payment of said claim or share when the amount thereof does not exceed five hundred pesos or its equivalent in dollars, except in case said father or mother is an imbecile, insane, vagrant or vicious person, or...
