Order of Presidential Succession in Case of Permanent Vacancy or Temporary Disability

- Permanent Vacancy (Death, Removal, Resignation) before 1987 Presidential Election (Section 1):
• Speaker of Batasang Pambansa acts as President until new President/Vice President elected and qualified.
• If Speaker unable, Prime Minister acts as President.
• If Prime Minister unable, Deputy Prime Minister acts as President.
• If Deputy Prime Minister unable, Batasang Pambansa elects a Member to act as President.
• Acting President subject to same restrictions as Speaker under Section 9, Article VII of the Constitution.

- President-elect Dies before Term Begins (Section 2):
• Vice President-elect becomes President.

- President Not Chosen or Failed to Qualify before Term Begins (Section 3):
• Vice President acts as President until President qualifies.

- Neither President-elect nor Vice President-elect Chosen, Qualified, or Both Died before Term Begins (Section 4):
• Prime Minister acts as President.
• If Prime Minister unable, line of succession: Speaker, Deputy Prime Minister, Speaker Pro Tempore.

- Permanent Vacancy (Death, Removal, Resignation) during Term (Section 5):
• Vice President becomes President for unexpired term.
• If both President and Vice President vacant, line of succession: Prime Minister, Speaker, Deputy Prime Minister, Speaker Pro Tempore.
• If Speaker Pro Tempore unable, Batasang Pambansa elects a qualified Member as President.

- Temporary Disability of President (Section 6):
• President transmits written declaration to Speaker of inability to discharge duties.
• Vice President acts as Acting President until President transmits contrary declaration.
• If no Vice President, Prime Minister or Speaker acts as Acting President.

- Repeals Inconsistent Laws (Section 7)

- Effective upon Approval (Section 8)

BATAS PAMBANSA BLG. 882 AN ACT PRESCRIBING THE ORDER OF SUCCESSION TO THE OFFICE OF THE PRESIDENT IN CASE OF PERMANENT VACANCY OR IN THE EVENT OF TEMPORARY DISABILITY OF THE PRESIDENT Section 1. In case of permanent disability, death, removal from office or resignation of the President, before the presidential election of 1987, the Speaker of the Batasang Pambansa shall act as President until a President and a Vice-President or either of them shall have been elected and shall have qualified. In case of death, permanent disability or resignation of the Speaker at the time this vacancy in the Office of the President occurs or subsequently thereafter, the Prime Minister shall act as President. However, should the Prime Minister fail or refuse for any cause whatsoever to assume or continue to act as President, the Deputy Prime Minister shall act as President. In case of his inability, the Speaker Pro Tempore, or if the Speaker Pro Tempore fails to assume office for any cause as provided herein, the Members of the Batasang Pambansa shall...
