Amendments to Retirement Pay for Certain Retirees
- Amends Section 2 of Republic Act No. 1862, as amended:
• Retirees who received gratuity under Republic Act No. 340 and/or Republic Act No. 1616, with effective retirement date between June 22, 1957 and September 9, 1979, and covered by clauses (a) and (b) of Section 1 of RA 1862, may opt to receive annual retirement pay instead of the gratuity paid to them. (Section 1)
• The option can be exercised within 5 years from the approval of this Act by the widows and/or minor children of the retirees who could not exercise the option due to death. (Section 1)
• No retirement pay shall be paid for the period prior to the approval of this Act. (Section 1)

Funding and Implementation
• For the current calendar year, the necessary amount shall be charged against the savings in the programmed appropriations for the current operating expenditures of the Headquarters, Armed Forces of the Philippines, net of reserve. (Section 2)
• Thereafter, the necessary amount shall be included in the annual General Appropriations Act. (Section 2)

Effectivity
• This Act shall take effect upon its approval. (Section 3)

BATAS PAMBANSA BLG. 644 AN ACT FURTHER AMENDING SECTION TWO OF REPUBLIC ACT NUMBERED EIGHTEEN HUNDRED AND SIXTY-TWO, AS AMENDED Section 1. Section two of Republic Act Numbered Eighteen hundred and sixty-two, as amended, is further amended to read as follows: "Sec. 2. Person who were retired and paid gratuity under said Republic Act Numbered Three hundred forty and/or Republic Act Numbered Sixteen hundred sixteen as amended, with the effective date of retirement after June twenty-two, nineteen hundred fifty-seven but before September ten, nineteen hundred seventy-nine, and who come within the purview of clauses (a) and (b) of the preceding section may, at their option, elect to receive, in lieu of such gratuity paid to them, the annual retirement pay as provided in Section two of Republic Act Numbered Three Hundred forty, as amended; and upon making such election, said persons shall, subject to the provisions and limitations hereinafter provided, be entitled to receive the annual retirement pay as provided in Section two of Republic Act Numbered Three hundred forty, as amended.
