AN ACT CONVERTING THE BUKIDNON STATE COLLEGE IN THE CITY OF MALAYBALAY, PROVINCE OF BUKIDNON, INTO A STATE UNIVERSITY, TO BE KNOWN AS THE BUKIDNON STATE UNIVERSITY ANDAPPROPRIATING FUNDS THEREFOR

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. Conversion. - The Bukidnon State College in the City of Malaybalay, Province of Bukidnon is hereby converted into a state university to be known as the Bukidnon State University, hereinafter referred to as the University.

Section 2. General Mandate. - The University shall primarily provide advanced education, higher technological, professional instruction and training in the fields of education, arts and sciences, public, administration, information technology, accountancy, law and other relevant fields of study. Conversion of Bukidnon State College into Bukidnon State University
- Section 1: Converts Bukidnon State College into Bukidnon State University.

General Mandate
- Section 2: The University shall provide advanced education, higher technological and professional instruction in fields like education, arts, sciences, public administration, IT, accountancy, law, etc. It shall promote research and extension services.

Curricular Offerings
- Section 3: The University shall offer graduate, undergraduate and short-term technical courses. Existing elementary and high schools shall be transferred to DepEd, but can operate within campus until students complete their education. The University may operate a laboratory school if it has a College of Education.

Administration and Corporate Powers
- Section 4: The University shall have general corporate powers. Its administration shall be vested in the Board of Regents and the President.

The Governing Board
- Section 5: The governing board is the Board of Regents, composed of the CHED Chairperson (Chair), University President (Vice Chair), Senate and House education committee chairs, NEDA and DOST regional directors, faculty association president, student council president, alumni association president, and two private sector representatives appointed by the Board.

Policies and Standards
- Section 6: The Board shall implement policies in accordance with the Constitution and CHED standards.

Powers and Duties of the Board
- Section 7: The Board has various powers and duties, including:
- Promulgating rules and regulations (7a)
- Receiving and appropriating funds for the University (7b)
- Importing duty-free books and publications (7c)
- Receiving donations and administering them (7d)
- Fixing tuition fees and other charges, which shall form special trust funds for the University (7e)
- Adopting a socialized tuition scheme for the poor (7f)
- Authorizing construction, repairs, and acquisition of property (7g)
- Appointing University officials and employees (7h)
- Fixing and adjusting salaries, granting leaves (7i)
- Approving curricula and rules of discipline (7j)
- Setting admission and graduation policies (7k)
- Awarding honorary degrees and certificates (7l)
- Establishing branches and centers in Region X (7m)
- Establishing research and extension centers (7n)
- Establishing chairs and providing fellowships/scholarships (7o)
- Delegating powers to the President (7p)
- Authorizing external management audits (7q)
- Collaborating with other state colleges/universities in the region (7r)
- Entering joint ventures for development (7s)
- Developing consortia and linkages (7t)
- Developing academic arrangements for capability building (7u)
- Setting up innovative modes of knowledge transmission (7v)
- Establishing policy guidelines for participative decision-making (7w)
- Privatizing non-academic services management (7x)
- Extending the President's term beyond retirement age but not beyond 70, if performance is outstanding (7y)

Meetings of the Board
- Section 8: The Board shall meet at least quarterly, with a majority quorum. The CHED Chair shall preside, but can designate a Commissioner as regular Chair. Congressional committee chairs may designate representatives.

The University President
- Section 9: The University shall be headed by a President appointed by the Board based on qualifications set by the Board, with a 4-year term renewable for another term. Incumbent Bukidnon State College President shall be the first University President.

The Administrative Council
- Section 10: An Administrative Council consisting of the President, Vice Presidents, Deans, Directors and other officials shall review and recommend policies on administration, management and planning.

The Academic Council
- Section 11: An Academic Council with the President as Chair and faculty members as members shall review and recommend curricular offerings, rules of discipline, admission and graduation requirements.

The Secretary and Treasurer
- Section 12: The Board shall appoint a Secretary.
- Section 13: The Treasurer of the Philippines shall be the ex officio Treasurer of the University.

Faculty
- Section 14: No discrimination shall be made in hiring faculty based on political beliefs, gender, culture, ethnicity or religion. Appointment shall follow Board guidelines.

Scholarship Program and Admission
- Section 15: The University shall provide scholarships and affirmative action programs for poor but deserving students. No discrimination in admission.

Academic Freedom and Autonomy
- Section 16: The University shall enjoy academic freedom and institutional autonomy.

Authority to Loan Equipment and Detail Personnel
- Section 17: National government bureaus and offices may loan equipment and detail employees to the University.

Assets, Liabilities and Personnel
- Section 18: All assets, personnel, records and liabilities of Bukidnon State College shall be transferred to the University. Tenured personnel shall be respected. Government lands occupied shall be property of the University.

Appropriations
- Section 19: Initial implementation shall be charged against current Bukidnon State College appropriations. Thereafter, the University's budget shall be included in the annual General Appropriations Act.

Development Plan, Audit and Structure
- Section 20: Within 120 days, the University shall submit a 5-year development plan to CHED, undergo a management audit, and set up its organizational, administrative and academic structure.

Reporting
- Section 21: The Board shall file an annual report on the University's progress, conditions and needs.

Application of Other Laws
- Section 22: The Higher Education Modernization Act shall be an integral part of this Act.
- Section 23: Other powers and responsibilities granted to state universities shall be granted to this University.

Implementing Rules
- Section 24: The Board, in consultation with CHED, shall formulate implementation guidelines.

Separability Clause
- Section 25: If any part is declared invalid, the remaining provisions shall remain in force.

Repealing Clause
- Section 26: All laws inconsistent with this Act are repealed or modified accordingly.

Effectivity
- Section 27: This Act shall take effect 15 days after publication in two newspapers of general circulation.
