- The Don Honorio Ventura College of Arts and Trades in Bacolor, Pampanga, including its satellite campus in Mexico, Pampanga, is converted into a state university called the Don Honorio Ventura Technological State University (DHVTSU). (Section 1)
General Mandate
- The University shall primarily provide advanced instruction and professional training in education, engineering, science and technology, arts and humanities, computer and other relevant fields. (Section 2)
- It shall undertake research, extension services and production activities in support of the socioeconomic development of Pampanga. (Section 2)
Curricular Offerings
- The University shall offer undergraduate and graduate courses in education, engineering, science and technology, arts and humanities, computer and other degree courses within its areas of specialization. (Section 3)
- No degree program shall be offered without the approval of the Commission on Higher Education (CHED). (Section 3)
- The University may operate a reasonably-sized laboratory school if it has a College of Education. (Section 3)
Administration
- The administration of the University and the exercise of its corporate powers shall be vested in the Board of Regents and the President of the University. (Section 4)
The Governing Board (Board of Regents)
- The governing board shall be the Board of Regents, composed of: (Section 5)
- Chairperson of CHED (Chairperson)
- President of the University (Vice Chairperson)
- Chairpersons of the Senate and House Committees on Education
- Regional Directors of NEDA and DOST
- Presidents of faculty, student, and alumni federations
- Two prominent citizens from the private sector
- The Board shall promulgate and implement policies in accordance with the declared State policies on education and the policies of CHED. (Section 6)
Powers and Duties of the Board of Regents
- The Board shall have the following powers and duties: (Section 7)
- Promulgate rules and regulations to carry out the purposes and functions of the University. (Section 7a)
- Receive and appropriate sums for the support of the University. (Section 7b)
- Import duty-free books, machineries and equipment for educational purposes. (Section 7c)
- Receive and administer legacies, gifts and donations. (Section 7d)
- Fix tuition fees and other necessary school charges. (Section 7e)
- Adopt and implement a socialized scheme of tuition and other school fees. (Section 7f)
- Authorize construction, repair of buildings, and purchase of real property. (Section 7g)
- Appoint Vice Presidents, deans, faculty members, and other officials and employees. (Section 7h)
- Fix and adjust salaries of faculty and staff. (Section 7i)
- Approve curricula, instructional programs and rules of discipline. (Section 7j)
- Set policies on admission and graduation of students. (Section 7k)
- Award honorary degrees and certificates of completion. (Section 7l)
- Establish and absorb non-chartered tertiary institutions as branches and centers. (Section 7m)
- Establish research and extension centers. (Section 7n)
- Establish professorial chairs and provide fellowships and scholarships. (Section 7o)
- Delegate powers and duties to the President and other officials. (Section 7p)
- Authorize an external management audit. (Section 7q)
- Collaborate with other governing boards for restructuring. (Section 7r)
- Enter into joint ventures with business and industry. (Section 7s)
- Develop consortia and other linkages with LGUs, institutions and agencies. (Section 7t)
- Develop academic arrangements for capability building. (Section 7u)
- Set up modern modes of transmitting knowledge. (Section 7v)
- Establish policy guidelines for participative decision-making. (Section 7w)
- Privatize the management of non-academic services. (Section 7x)
- Extend the term of the President beyond retirement age but not beyond 70 years old, if performance is outstanding. (Section 7y)
Meetings of the Board
- The Board shall convene at least once every quarter. (Section 8)
- The Chairperson may call a maximum of two special meetings with three days' prior written notice. (Section 8)
- A quorum shall consist of a majority of all members, with the Chairperson or President present. (Section 8)
The University President
- The University shall be headed by a President who shall render full-time service. (Section 9)
- The President shall be appointed by the Board for a term of four years and may be reappointed for another term. (Section 9)
- The incumbent President of the Don Honorio Ventura College of Arts and Trades shall serve as the first President of the University, if qualified. (Section 9)
Head of University Campus
- A Campus Director shall head the University campus and render full-time service. (Section 10)
- The Campus Director shall be appointed by the Board upon recommendation of the search committee and the President. (Section 10)
- The incumbent college administrator of the extension campus shall serve as Campus Director of the extension campus. (Section 10)
The Administrative Council and Academic Council
- There shall be an Administrative Council to review and recommend policies governing administration, management and development planning. (Section 11)
- There shall be an Academic Council to review and recommend curricular offerings, rules of discipline, admission and graduation requirements. (Section 12)
Secretary and Treasurer of the University
- The Board shall appoint a Secretary who shall keep records and proceedings of the Board. (Section 13)
- The Treasurer of the Philippines shall be the ex officio treasurer of the University. (Section 14)
The Faculty
- No political beliefs, gender preference, cultural or community affiliation, ethnic origin, and religious opinion or affiliation shall be a matter of inquiry in the appointment of faculty members. (Section 15)
- No faculty member shall teach for or against any particular church or religious sect. (Section 15)
Scholarship Program and Admission
- The University shall provide a scholarship program and other affirmative action programs to assist poor but deserving students. (Section 16)
- No student shall be denied admission by reason of sex, religion, cultural or community affiliation or ethnic origin. (Section 16)
Academic Freedom and Institutional Autonomy
- The University shall enjoy academic freedom and institutional autonomy. (Section 17)
Authority to Loan or Transfer Apparatus, Equipment, Supplies and Detail Personnel
- Heads of national government bureaus and offices are authorized to loan or transfer apparatus, equipment or supplies as needed by the University. (Section 18)
- They are also authorized to detail employees for duty in the University. (Section 18)
Assets, Liabilities and Personnel
- All assets, real and personal, personnel, records, liabilities and obligations of the Don Honorio Ventura College of Arts and Trades are transferred to the University. (Section 19)
- The positions, rights and security of tenure of faculty and personnel shall be respected. (Section 19)
- All parcels of land occupied by the College shall be property of the University. (Section 19)
Appropriations
- The amount necessary to carry out the provisions of this Act shall be charged against the current year's appropriations of the Don Honorio Ventura College of Arts and Trades, except for the sums needed to continue the operations of the existing high school. (Section 20)
- Thereafter, the sums necessary for the operation and maintenance of the University shall be included in the annual General Appropriations Act. (Section 20)
Development Plan, Management Audit, Organizational Structure
- Within 120 days after the approval of this Act, the University shall: (Section 21)
- Submit a five-year development plan, including program budget, to CHED.
- Undergo a management audit in cooperation with CHED.
- Set up its organizational, administrative, and academic structure, including appointment of key officials.
CHED Monitoring and Evaluation
- CHED shall conduct regular monitoring and evaluation to determine continuing compliance with the requirements on University status. (Section 22)
- If the University does not maintain compliance, CHED shall recommend revocation of the University status. (Section 22)
Filing of Report
- On or before the 15th day of the second month after the opening of regular classes each year, the Board shall file a detailed report on the progress, conditions and needs of the University with the Office of the President of the Philippines, CHED, and both Houses of Congress. (Section 23)
Suppletory Application
- The provisions of Republic Act No. 8292 (Higher Education Modernization Act of 1997) shall be an integral part of this Act and shall serve as part of the Governing Charter of the University. (Section 24)
Parity Clause
- All other powers, functions, privileges, responsibilities and limitations to state universities and/or their officials under existing laws shall be deemed granted to or imposed upon the University and/or its officials. (Section 25)
Implementing Rules and Regulations
- The Board, in consultation with CHED, shall formulate the guidelines to fully implement the provisions of this Act. (Section 26)
Separability Clause
- If any part or provision of this Act is declared invalid or unconstitutional, the remaining parts or provisions not affected shall remain in full force and effect. (Section 27)
Repealing Clause
- All laws, presidential decrees, executive orders, rules and regulations contrary to or inconsistent with the provisions of this Act are hereby repealed or modified accordingly. (Section 28)
Effectivity
- This Act shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation. (Section 29)

AN ACT CONVERTING THE DON HONORIO VENTURA COLLEGE OF ARTS AND TRADES IN THE MUNICIPALITY OF BACOLOR, PROVINCE OF PAMPANGA INTO A STATE UNIVERSITY TO BE KNOWN AS THE DON HONORIO VENTURA TECHNOLOGICAL STATE UNIVERSITY (DHVTSU) AND APPROPRIATING FUNDS THEREFOR
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section 1. Conversion. - The Don Honorio Ventura College of Arts and Trades in the Municipality of Bacolor, including its satellite/extension campus in the Municipality of Mexico, both located in the Province of Pampanga is hereby converted into a state university, to be known as the Don Honorio Ventura Technological State University (DHVTSU), hereinafter referred to as the University.
