AN ACT CONVERTING THE EASTERN SAMAR STATE COLLEGES (ESSC) INTO A STATE UNIVERSITY TO BE KNOWN AS THE EASTERN SAMAR STATE UNIVERSITY, INTEGRATING THEREWITH THE MAYDOLONG NATIONAL AGRICULTURAL SCHOOL IN THE MUNICIPALITY OF MAYDOLONG, PROVINCE OF EASTERN SAMAR AND APPROPRIATING FUNDS THEREFOR
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Conversion. – The Eastern Samar State College (ESSC) is hereby converted into a State University to be known as the Eastern Samar State University (ESSU), integrating therewith the Maydolong National Agricultural School in the Municipality of Maydolong, Province of Eastern Samar.
The main campus of the University shall be in Borongan, Eastern Samar.

Summary of Republic Act No. 9312:
Conversion and Integration
- The Eastern Samar State College (ESSC) is converted into the Eastern Samar State University (ESSU), integrating the Maydolong National Agricultural School. (Section 1)
- The main campus of the University shall be in Borongan, Eastern Samar. (Section 1)
Mandate and Curricular Offerings
- The University shall provide advanced education, higher technology, professional instruction and training in fields like industry, computer and information technology, forestry, environmental sciences, agriculture, veterinary medicine, fishery, and medicine. (Section 2)
- The University shall offer undergraduate and graduate courses in sciences, technology, literature, humanities, philosophy, agriculture, education, forestry, arts and science, and other degrees/courses within its areas of specialization. (Section 3)
- Existing high schools shall be transferred to the Department of Education, but the University may operate a laboratory school if it has a College of Education. (Section 3)
Administration and Governing Board
- The administration and exercise of corporate powers shall be vested in the Board of Regents and the President of the University. (Section 4)
- The Board of Regents shall be the governing board, composed of various members including the CHED Chairperson, University President, Congressional Committee Chairpersons, government agency representatives, faculty, student, and alumni federation presidents, and two prominent citizens. (Section 5)
- The Board shall promulgate and implement policies in accordance with state policies on education, agriculture, science and technology, and CHED policies. (Section 6)
- The Board shall have various powers and duties related to promulgating rules, receiving funds, importing duty-free books, receiving donations, fixing tuition fees, authorizing construction and repairs, appointing officials and employees, approving curricula, awarding degrees, establishing branches and centers, establishing research and extension centers, providing fellowships and scholarships, delegating powers, authorizing audits, collaborating with other institutions, entering joint ventures, developing consortia, adopting modern teaching modes, setting policies, and privatizing non-academic services. (Section 7)
- The Board shall meet at least once every quarter, with a quorum consisting of a majority of members. (Section 8)
- The University President shall be appointed by the Board, serve a 4-year term, and be eligible for reappointment. The incumbent ESSC President shall serve as the first ESSU President. (Section 9)
- There shall be an Administrative Council and an Academic Council to implement policies and review curricular offerings, respectively. (Sections 10-11)
- The Board shall appoint a Secretary and the Treasurer of the Philippines shall be the ex officio Treasurer of the University. (Sections 12-13)
Faculty, Scholarships, and Academic Freedom
- Faculty appointments shall not be based on religion, political beliefs, gender, cultural affiliation, or ethnic origin, subject to Board guidelines. No faculty shall teach for or against any particular religion. (Section 14)
- The University shall provide a scholarship program and affirmative action programs to assist poor but deserving students. No student shall be denied admission based on sex, religion, cultural affiliation, or ethnic origin. (Section 15)
- The University shall enjoy academic freedom and institutional autonomy. (Section 16)
Assets, Liabilities, and Personnel Transfer
- All assets, liabilities, personnel, and records of ESSC and Maydolong National Agricultural School shall be transferred to ESSU. The rights and tenure of personnel shall be respected. (Section 18)
- All government land occupied by ESSC and Maydolong National Agricultural School shall be property of ESSU, but shall revert to the Province of Eastern Samar if the University ceases to exist or no longer needs the land. (Section 18)
Appropriations and Development Plan
- Necessary funds shall be charged against the current year's appropriations of ESSC and Maydolong National Agricultural School, except for continuing high school operations. Thereafter, funds shall be included in the annual General Appropriations Act. (Section 19)
- Within 120 days, the University shall submit a 5-year development plan and program budget to CHED, undergo a management audit, and set up its organizational, administrative, and academic structure. (Section 20)
- The Board shall file an annual report on the progress, conditions, and needs of the University with the Office of the President and Congress. (Section 21)
Other Provisions
- The Higher Education Modernization Act of 1997 shall be an integral part of this Act and serve as part of the University's governing charter. (Section 22)
- All laws contrary to or inconsistent with this Act are repealed or modified accordingly. (Section 23)
- This Act shall take effect upon approval. (Section 24)
