REPUBLIC ACT NO. 9025 March 05, 2001

AN ACT CONVERTING THE MUNICIPALITY OF ALAMINOS, PROVINCE OF PANGASINAN INTO A COMPONENT CITY TO BE KNOWN AS THE CITY OF ALAMINOS

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

ARTICLE I
GENERAL PROVISIONS

Section 1. Title. - This Act shall be known as the "Charter of the City of Alaminos."

Section 2. The City of Alaminos.- The Municipality of Alaminos shall be converted into a component city to be known as the City of Alaminos, hereinafter referred to as the City, which shall comprise the present jurisdiction of the Municipality of Alaminos, Pangasinan Province. The territorial jurisdiction of the City shall be within the present metes and bounds of the Municipality of Alaminos, as follows:

Conversion of Municipality to City (Sections 1-2)

- Outlines the rules for permanent vacancies in the offices of Mayor, Vice Mayor, and Sangguniang Panlungsod members.
- Temporary vacancy in the Office of the City Mayor is covered.

Appointive Officials and Their Duties (Sections 25-46)
- Qualifications, powers, and duties of various appointive officials are specified, including:
  - Secretary to the Sangguniang Panlungsod
  - City Treasurer and Assistant City Treasurer
  - City Assessor and Assistant City Assessor
  - City Accountant, Budget Officer, Planning and Development Coordinator

Transitory and Final Provisions (Sections 51-63)
- Existing municipal ordinances remain in force until amended by the Sangguniang Panlungsod.
- A plebiscite will be conducted within 60 days to ratify the City's creation, with expenses borne by the Municipality.
- Current elective and appointive officials will continue until new elections and appointments.
- The City succeeds to all assets, properties, liabilities, and obligations of the Municipality.
- Qualified voters can vote and run for provincial elective positions in Pangasinan.
- The City remains under the jurisdiction of Pangasinan Province, unless otherwise provided by law.
- No increase in local tax rates shall be imposed for 5 years after the City's creation.
- The City remains part of the First Congressional District of Pangasinan until changed by law.
- The Local Government Code of 1991 and applicable laws govern the City.
- Boundary disputes with adjoining LGUs can still be determined by appropriate agencies.
- Separability clause and repealing clause for inconsistent laws are included.
- The Act takes effect upon publication in at least two newspapers.
