- The Tangub Agro-Industrial School in Tangub City, Misamis Occidental is converted into a state college called the Northwestern Mindanao State College of Science and Technology. (Section 1)
Mandate and Offerings of the State College
- The State College shall primarily offer higher professional, technical instructions, promote research and extension services, advanced studies, and progressive leadership in education, agriculture, fishery, engineering, arts and sciences, short-term vocational-technical and other continuing courses. (Section 2)
- It shall give primary consideration to the integration of research and studies for the development of Misamis Occidental. (Section 2)
- The existing high school shall be transferred to the Department of Education, Culture and Sports (DECS), but it can remain within the campus until it is transferred or its students are accommodated elsewhere. The State College may operate a laboratory school if it has a college of education. (Section 2)
- The State College shall offer undergraduate, graduate, and short-term courses within its area of specialization as deemed necessary by the Board of Trustees. (Section 3)
Powers and Governance
- The State College shall have the general powers of a corporation set forth in the corporation law. (Section 4)
- The administration and exercise of corporate powers shall be vested in the Board of Trustees and the president of the State College. (Section 4)
- The governing body is the Board of Trustees, composed of representatives from various government agencies, faculty, students, alumni, and prominent citizens. (Section 5)
- The Board of Trustees shall promulgate and implement policies in accordance with declared policies on education, science and technology, arts, culture and sports, and the policies of the Commission on Higher Education (CHED). (Section 6)
- The Board of Trustees has specific powers and duties outlined in Section 7, including enacting rules and regulations, receiving and appropriating funds, receiving donations and legacies, fixing tuition fees and other charges, adopting a socialized tuition scheme, authorizing construction and repairs, appointing officials and employees, approving curricula and programs, awarding honorary degrees, absorbing non-chartered tertiary institutions, establishing research and extension centers, delegating powers, authorizing external audits, collaborating with other institutions, developing academic arrangements, adopting modern modes of knowledge transmission, establishing policy guidelines for participative decision-making, privatizing non-academic services, and extending the term of the president beyond retirement age under certain conditions.
Board of Trustees Meetings and Administration
- The Board of Trustees shall convene at least once every quarter, and the chairman may call special meetings. (Section 8)
- The administration of the State College shall be vested in the president, who shall be appointed by the Board of Trustees upon the recommendation of a search committee. The president shall have a term of four years and shall be eligible for reappointment for another term. (Section 9)
- There shall be an administrative council consisting of the president, vice president(s), deans, directors, and other officials to implement policies governing administration, management, and development planning. (Section 10)
- There shall be an academic council with the president as chairman and all instructional staff with the rank of not lower than assistant professor as members, responsible for prescribing curricular offerings, admission requirements, and disciplinary powers over students. (Section 11)
- There shall be a secretary of the State College appointed by the Board upon the recommendation of the president. (Section 12)
- The Treasurer of the Philippines shall be the ex officio treasurer of the State College. (Section 13)
- No student shall be denied admission based on sex, nationality, religion, or political affiliation. (Section 14)
Transition and Reporting
- The appointment of the officer-in-charge pending the appointment of the president shall be made by the CHED. (Section 15)
- The Board shall file a detailed report on the progress, conditions, and needs of the State College with the Office of the President of the Philippines, through the CHED chairperson and both Houses of Congress, on or before the fifteenth day of the second month after the opening of regular classes each year. (Section 16)
- All assets, personnel, records, liabilities, and obligations of the Tangub Agro-Industrial School are transferred to the State College. The positions, rights, and security of tenure of personnel are not impaired. All parcels of land occupied by the Tangub Agro-Industrial School are declared the property of the State College and shall be titled under that name. (Section 17)
- All accounts and expenses of the State College shall be audited by the Commission on Audit or its authorized representative. (Section 18)
- Heads of national government bureaus and offices are authorized to loan or transfer apparatus, equipment, supplies, or detail employees for duty in the State College when such resources can be spared without detriment to public service. (Section 19)
- The amount necessary to carry out the provisions of this Act shall be charged against the current year's appropriations of the Tangub Agro-Industrial School, except for the sum needed to continue the operations of the existing high school. Thereafter, the necessary amount for the continued operations and maintenance of the State College shall be included in the annual General Appropriations Act. (Section 20)
Repealing and Effectivity Clauses
- All laws, presidential decrees, executive orders, rules, and issuances inconsistent with the provisions of this Act are repealed, amended, or modified accordingly. (Section 21)
- If any section or provision of this Act is held unconstitutional or invalid, the other sections or provisions shall not be affected. (Section 22)
- This Act shall take effect fifteen (15) days following its publication in at least two newspapers of general circulation. (Section 23)
