- A portion of the Municipality of Esperanza is separated and made part of the Municipality of Las Nieves, Agusan del Norte. (Section 3)
Agusan del Sur
- Consists of the municipalities of Bayugan, Esperanza, Prosperidad, San Francisco, Bunawan, Talacogon, La Paz, Loreto, Vereula, and Santa Josefa. (Section 4)
Provincial Capitals
- The capital of Agusan del Norte is Butuan City. (Section 5)
- The capital of Agusan del Sur is the Municipality of Prosperidad. (Section 5)
Applicability of Laws
- All provisions of law applicable to regular provinces shall be applicable to Agusan del Norte and Agusan del Sur, except as provided in the Act. (Section 6)
Effectivity and Implementation
- The division shall become effective if the majority of voters in Agusan Province favor the division in a plebiscite held simultaneously with the November 1967 elections. (Section 7)
- If the division is favored, the new provinces shall be organized immediately upon the special elections of provincial officials and Members of the House of Representatives for Agusan del Norte and Agusan del Sur in the November 1969 general elections. (Section 7)
- Provincial officials elected for Agusan Province in 1967 shall become the officials of Agusan del Norte and serve until their successors are elected and qualified. (Section 7)
- The Provincial Board of Canvassers of Agusan Province shall canvass the votes cast in the special elections for Agusan del Sur in 1969. (Section 8)
Division of Obligations, Funds, Assets, and Properties
- Upon the organization of the new provinces, the obligations, funds, assets, and other properties of the present Province of Agusan shall be divided equally between Agusan del Norte and Agusan del Sur by the President of the Philippines upon the recommendation of the Auditor General. (Section 9)
Effectivity
- The Act shall take effect upon its approval. (Section 10)

AN ACT CREATING THE PROVINCES OF AGUSAN DEL NORTE AND AGUSAN DEL SUR
Section 1. The Province of Agusan is hereby divided into two provinces, to be known as Agusan del Norte and Agusan del Sur.
Section 2. The Province of Agusan del Norte shall consist of the portion of the present Province of Agusan comprising the Municipalities of Carmen, Nasipit, Buenavista, Cabadbaran, Tubay, Jabonga, Kitcharao, and Las Nieves.
Section 3. A portion of the present Municipality of Esperanza, described as follows: Beginning at a point on the old Agusan-Misamis Oriental boundary approximately 8º39' 30" north latitude; thence due east in a straight line until Barrio Maasiin; thence, in a straight line N 55º15' east following the Agusan del Norte and Agusan del Sur boundary until its intersection with the old Las Nieves-Esperanza boundary approximately 9.80 kilometers away; thence, due north approximately 45º north following the old Las Nieves-Esperanza boundary up to the old boundary of the Municipalities of Buenavista and Esperanza, shall be separated from the said municipality and shall...
