AN ACT DESIGNATING THE BAYANIHAN PHILIPPINE DANCE COMPANY AS THE PHILIPPINE NATIONAL FOLK DANCE COMPANY, DEFINING ITS ROLE AND FUNCTIONS AS SUCH, AND APPROPRIATING FUNDS THEREFORE

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled::

Section 1. Declaration of Policy. – Pursuant to Article II, Sections 17 and 23, and Article XIV, Sections 14, 15 and 18(2) of the Philippine Constitution, it is hereby declared the policy of the State to appropriately recognize, designate and support nongovernment organizations that have demonstrated pioneering, long, consistent and unassailable competence, effectiveness and success in researching and documenting Philippine folk art and culture and transforming these into art forms and cultural fame that have won and continue to win national as well as international validity, recognition, acceptance and renown.

Summary of Republic Act No. 8626

Declaration of Policy (Section 1)
- The State shall recognize, designate and support non-government organizations that have demonstrated excellence in researching, documenting, and promoting Philippine folk art and culture.

Designation as Philippine National Folk Dance Company (Section 2)
- The Bayanihan Philippine Dance Company is designated as the Philippine National Folk Dance Company, having fulfilled the following criteria:
    - It is national in scope, presenting arts, culture, traditions, issues, and concerns of the nation.
    - It maintains the highest standard of excellence in its productions, artists, and activities.
    - It has represented the country internationally and received acclaim.
    - It has a track record of artistic excellence and a sustainable organization.

Role and Functions (Section 3)
- Undertake research and documentation of Philippine folk culture, with emphasis on rituals, dances, songs, music, decorations, and ornaments. (Section 3a)
- Document the research results in various media forms for distribution to schools and the public. (Section 3b)
- Develop a pool of folk dance masters to train and maintain a permanent corps of dancers for a national dance outreach program. (Section 3c)
- Develop and maintain a world-class company to perform during state visits and events, both in the Philippines and abroad. (Section 3d)
- Conduct fundraising projects to support other Bayanihan projects. (Section 3e)
- Prepare a new repertoire based on the themes and topics of the Centennial of Philippine Independence in 1998 for national and international performances. (Section 3f)

Entitlement (Section 4)
- Free use of theater facilities, office space, rehearsal studios, production and technical facilities at the Cultural Center of the Philippines, with reasonable charges for utilities. (Sections 4a and 4b)
- Project grants for research, documentation, and/or production from the National Commission on Culture and Arts. (Section 4c)

Memorandum of Agreement (Section 5)
- The Cultural Center of the Philippines shall execute necessary arrangements with the Bayanihan Philippine Dance Company within 30 days upon the effectivity of this Act.

Additional National Folk Dance Companies (Section 6)
- The President of the Philippines may designate additional national folk dance companies with the same entitlements and privileges, upon the recommendation of the Secretary of Education, Culture and Sports.

Appropriation of Funds (Section 7)
- Five million pesos (P5,000,000.00) is appropriated to support the roles and functions stated in Section 3.
- Subsequent funds necessary to sustain the roles and functions shall be included in the annual General Appropriations Act.

Separability Clause (Section 8)
- If any part or provision of this Act is declared invalid or unconstitutional, the remaining parts or provisions shall remain in full force and effect.

Repealing Clause (Section 9)
- All laws, rules and regulations inconsistent with the provisions of this Act are hereby repealed or amended accordingly.

Effectivity (Section 10)
- This Act shall take effect upon its approval.
