REPUBLIC ACT No. 10742

AN ACT ESTABLISHING REFORMS IN THE SANGGUNIANG KABATAAN CREATING ENABLING MECHANISMS FOR MEANINGFUL YOUTH PARTICIPATION IN NATION-BUILDING, AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

CHAPTER I
INTRODUCTORY PROVISIONS

SECTION 1. Title. – This Act shall be known as the “Sangguniang Kabataan Reform Act of 2015”.

SECTION 2. Declaration of State Policies and Objectives. – The State recognizes the vital role of the youth in nation-building .and thus, promotes and protects their physical, moral, spiritual, intellectual and social well-being, inculcates in them patriotism, nationalism and other desirable values, and encourages their involvement in public and civic affairs.

Towards this end, the State shall establish adequate, effective, responsive and enabling mechanisms and support systems that will ensure the meaningful participation of the youth in local governance and ^Ln...

Introductory Provisions

- The Katipunan ng Kabataan elects the Sangguniang Kabataan chairperson and members, and serves as the highest policy-making body for youth matters in the barangay. (Section 5)
- Requires the Katipunan ng Kabataan to meet at least once every 6 months. (Section 6)
- Establishes the Sangguniang Kabataan in every barangay, composed of a chairperson and 7 members elected by the Katipunan ng Kabataan. (Section 7)
- Outlines the powers and functions of the Sangguniang Kabataan, including formulating a 3-year Comprehensive Barangay Youth Development Plan, approving the annual budget, implementing youth programs and projects, and partnering with the Local Youth Development Council (LYDC). (Section 8)

The Local Youth Development Council (LYDC)
- Mandates the creation of a Local Youth Development Council (LYDC) in every province, city, and municipality to ensure youth participation in local governance. (Section 23)
- Requires the LYDC to be funded by the respective Sangguniang Bayan, Sangguniang Panlungsod, and Sangguniang Panlalawigan. (Section 24)

The Local Youth Development Office
- Requires the creation of a Youth Development Office in every province, city, and municipality, headed by a youth development officer. (Section 25)
- Mandates the local government unit to incorporate funding for the Youth Development Office in its annual budget. (Section 26)

Capability-Building and Orientation Towards Nation-Building and Empowerment
- Requires Sangguniang Kabataan officials and LYDC members to undergo mandatory and continuing training programs on nation-building, leadership, and project management before assuming office. (Section 27)
- Outlines the components of the mandatory training programs, including Philippine cultural history, political systems, ethics, and capability building. (Section 28)
- Establishes a training fund with an initial amount of ₱50,000,000.00 to be managed by the Commission. (Section 29)

Linggo ng Kabataan
- Mandates the observance of Linggo ng Kabataan (Youth Week) annually on the week where August 12 falls, coinciding with International Youth Day. (Section 30)
- Requires the election of youth counterparts to local officials during the Linggo ng Kabataan. (Section 30)

Registration, Election and Assumption of Office
- Requires the COMELEC to set a special registration of the Katipunan ng Kabataan for at least 1 month, including Saturdays and Sundays, for the next regular Sangguniang Kabataan election. (Section 31)
- Synchronizes the Sangguniang Kabataan elections with the barangay elections every 3 years. (Section 32)

Final Provisions
- Appropriates the necessary funds for implementing the Act through the Annual General Appropriations Act. (Section 33)
- Requires the Commission, DILG, COMELEC, DBM, CHED, DepEd, and COA to issue the Implementing Rules and Regulations within 60 days upon approval of the Act. (Section 34)
- Includes a separability clause and repeals inconsistent laws and regulations. (Sections 35-36)
- Sets the effectivity date 15 days after publication in the Official Gazette or two newspapers of general circulation. (Section 37)
