AN ACT ESTABLISHING THE NUEVA VIZCAYA STATE UNIVERSITY IN THE PROVINCE OF NUEVA VIZCAYA BY INTEGRATING THE NUEVA VIZCAYA STATE INSTITUTE OF TECHNOLOGY IN THE MUNICIPALITY OF BAYOMBONG AND THE NUEVA VIZCAYA STATE POLYTECHNIC COLLEGE IN THE MUNICIPALITY OF BANBANG, BOTH LOCATED IN THE PROVINCE OF NUEVA VIZCAYA, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES.
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Establishment/Integration. – There is hereby established a state university in the Province of Nueva Vizcaya to be known as the Nueva Vizcaya State University, hereinafter referred to as the University, by integrating the Nueva Vizcaya State Institute of Technology in the Municipality of Bayombong and the Nueva Vizcaya State Polytechnic College in the Municipality of Bambang, both in the Province of Nueva Vizcaya....

Summary of Republic Act No. 9272:
Establishment and Integration
- Establishes the Nueva Vizcaya State University by integrating the Nueva Vizcaya State Institute of Technology and the Nueva Vizcaya State Polytechnic College. (Section 1)
- The main campus will be in Bayombong, Nueva Vizcaya. (Section 1)
General Mandate
- The University shall provide advanced instruction, professional training, research, and extension services in agriculture, arts, science, technology, education, and related fields. (Section 2)
Curricular Offerings
- The University shall offer graduate, undergraduate, and short-term technical courses within its areas of specialization. (Section 3)
- Existing high schools shall be transferred to the Department of Education, but may operate within the campus until current students complete their education. (Section 3)
- The University may operate a laboratory school for teacher education programs. (Section 3)
Administration
- The administration and corporate powers shall be vested in the Board of Regents and the University President. (Section 4)
Governing Board (Board of Regents)
- The Board of Regents shall be the governing body, composed of representatives from various government agencies, faculty, students, alumni, and prominent citizens. (Section 5)
- The Board shall promulgate and implement policies in accordance with state policies on education, agriculture, science, and technology. (Section 6)
- The Board has specific powers and duties outlined in Section 7, including enacting rules and regulations, receiving and appropriating funds, importing duty-free books, receiving donations, fixing tuition fees, adopting a socialized tuition scheme, authorizing construction and repairs, appointing officials and employees, approving curricula and rules, awarding degrees, establishing branches and centers, establishing research and extension centers, providing fellowships and scholarships, delegating powers, authorizing external audits, collaborating with other institutions, entering joint ventures, developing consortia and linkages, adopting modern teaching modes, setting policies for decision-making and transparency, privatizing non-academic services, and extending the term of the University President. - The Board shall meet at least once per quarter. (Section 8)
University President
- The University shall be headed by a President appointed by the Board for a term of 4 years, renewable for another term. (Section 9)
- The President shall be assisted by Vice Presidents for Academic Affairs and Administration. (Section 9)
- The powers and duties of the President shall be those pertaining to the office and those delegated by the Board. (Section 9)
Administrative Council
- The Administrative Council, chaired by the President, shall review and recommend policies governing the management, administration, and development of the University. (Section 10)
Academic Council
- The Academic Council, chaired by the President, shall review and recommend curricular offerings, rules of discipline, admission and graduation requirements, and formulate academic policies and rules. (Section 11)
Secretary and Treasurer
- The Board shall appoint a Secretary to keep records and proceedings. (Section 12)
- The Treasurer of the Philippines shall be the ex officio treasurer of the University. (Section 13)
Faculty
- No religious affiliation shall be a matter of inquiry in the appointment of faculty members, and no faculty member shall teach for or against any particular church or religious sect. (Section 14)
Scholarship Program and Admission
- The University shall provide a scholarship program and affirmative action programs to assist poor but deserving students. (Section 15)
- No student shall be denied admission based on sex, religion, cultural affiliation, or ethnic origin. (Section 15)
Academic Freedom and Institutional Autonomy
- The University shall enjoy academic freedom and institutional autonomy. (Section 16)
Reporting
- The Board shall file a detailed report on the progress, conditions, and needs of the University to the President of the Philippines and Congress annually. (Section 17)
Authority to Loan and Transfer Equipment
- Government bureaus and offices are authorized to loan or transfer apparatus, equipment, supplies, and detail employees for duty in the University. (Section 18)
Assets, Liabilities, and Personnel
- All assets, liabilities, personnel, and records of the Nueva Vizcaya State Institute of Technology and the Nueva Vizcaya State Polytechnic College shall be transferred to the University. (Section 19)
- Government lands occupied by the former institutions shall be titled under the name of the Nueva Vizcaya State University. (Section 19)
Appropriations
- The necessary funds shall be charged against the current year's appropriations of the former institutions, except for the existing high schools. (Section 20)
- Subsequent funding for the University's operations and maintenance shall be included in the annual General Appropriations Act. (Section 20)
Development Plan, Management Audit, and Organizational Structure
- Within 120 days, the University shall:
- Submit a 5-year development plan and program budget to CHED. (Section 21a)
- Undergo a management audit in cooperation with CHED. (Section 21b)
- Set up its organizational, administrative, and academic structure, including the appointment of key officials. (Section 21c)
- Establish at least 4 separate degree-granting units, one in arts and sciences and another at the graduate level. (Section 21d)
Incorporation of Republic Act No. 8292
- The provisions of Republic Act No. 8292 (Higher Education Modernization Act of 1997) shall form part of this Act and serve as the governing charter of the University. (Section 22)
Imposition of Powers
- All other powers, functions, privileges, responsibilities, and limitations to state colleges/universities and/or their officials under existing laws shall be deemed granted to or imposed upon the University and/or its officials whenever appropriate. (Section 23)
Transitory Provisions
- The Chairman of CHED shall appoint an officer-in-charge of the University pending the appointment of the President. (Section 24)
- The Board shall issue standards for accreditation of faculty, student, and alumni associations, and guidelines for selecting the first two prominent citizen members. (Section 24)
- The initial Board shall be composed of the first six members identified in Section 5, with the officer-in-charge serving as acting vice chairman if the President has not been appointed. (Section 24)
Repealing Clause
- All laws, presidential decrees, executive orders, rules, and regulations contrary to or inconsistent with this Act are repealed or modified accordingly. (Section 25)
Effectivity
- This Act shall take effect upon its approval. (Section 26)
