REPUBLIC ACT No. 10699

AN ACT EXPANDING THE COVERAGE OF INCENTIVES GRANTED TO NATIONAL ATHLETES AND COACHES, APPROPRIATING FUNDS THEREFOR, REPEALING FOR THE PURPOSE REPUBLIC ACT NO. 9064, ALSO KNOWN AS THE “NATIONAL ATHLETES, COACHES AND TRAINERS BENEFITS AND INCENTIVES ACT OF 2001” OR “SPORTS BENEFITS AND INCENTIVES ACT OF 2001”

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Short Title. — This Act shall be known as the “National Athletes and Coaches Benefits and Incentives Act”.

SECTION 2. Statement of Policy. — The State promotes excellence in sports by looking after the welfare of national athletes and coaches competing for the country and by providing benefits and incentives for national athletes and other athletes who win in international sports competitions and bring honor and recognition to the country.

Summary of the National Athletes and Coaches Benefits and Incentives Act

Definitions (Section 3):
- Athletes with disabilities: Persons with disabilities recognized by the Philippine Sports Commission (PSC) and National Paralympic Committee of the Philippines (NPC PHIL), who have represented the country in international sports competitions.
- International sports competitions: Regular major competitions like Olympic Games, Asian Games, SEA Games, Paralympic Games, etc.; World-level championships with at least 45 countries participating; Asian-level competitions with at least 25 countries participating; and qualifying competitions for World-level and Asian-level games.
- National athletes: Filipino citizens, members of the national training pool, recognized by the Philippine Olympic Committee (POC) and PSC, including athletes with disabilities recognized by NPC PHIL and PSC, who have represented the country in international sports competitions.
- National coaches: Coaches of national athletes, Filipino citizens, members of the national coaches training pool, recognized by the PSC and POC, or PSC and NPC PHIL for coaches of athletes with disabilities, who have represented the country as official coaches in international sports competitions.

Benefits and Privileges for National Athletes and Coaches (Section 4):
- 20% discount on transportation, hotels, restaurants, recreation centers, medicine, and sports equipment.
- Minimum 20% discount on admission fees to theaters, cinemas, concert halls, circuses, carnivals, and other similar places.
- Free medical and dental consultations in government hospitals.
- Coverage in the National Health Insurance Program (NHIP) of the Philippine Health Insurance Corporation (PHILHEALTH) through the sponsored program of the PSC.
- Comprehensive social security program to be formulated by the Social Security System within 180 days.
- Priority in existing livelihood programs of various government agencies.
- Priority in national housing programs, affordable "pabahay" loans, and other housing opportunities.
- Use of living quarters and training centers set up and maintained by the PSC.

Scholarship Benefits for National Athletes (Section 5):
- National athletes who win in regular major international sports competitions are entitled to full tuition fees from state colleges or universities for a college or university degree.
- Priority in the availment of state college or university scholarship grants.
- Priority for winning national athletes who seek scholarship grants and study under the Commission on Higher Education (CHED) and Technical Education and Skills Development Authority (TESDA) programs.
- Private colleges and universities are encouraged to adopt a similar program for winning national athletes.

Retirement Benefits for National Athletes and Coaches (Section 6):
- National athletes and coaches who win in international competitions shall receive a lump sum amount equivalent to 25% of their total cash incentives computed from the start of their active sports career up to retirement, as certified by the PSC.
- The lump sum amount shall be released 60 days from the filing of the retirement papers.

Death Benefits (Section 7):
- Upon the death of any national athlete and coach, the primary beneficiaries (legitimate spouse, children) shall be entitled to a lump sum benefit of P30,000.00 to cover funeral services.
- If no primary beneficiaries, the secondary beneficiaries (parents, siblings) shall be entitled to said benefits.

Cash Incentives for Athletes (Section 8):
- Specific cash incentives are provided for gold, silver, and bronze medalists in individual and team events across various international sports competitions, ranging from P10,000,000.00 for Olympic gold medalists to P30,000.00 for ASEAN Para Games bronze medalists.
- For team events with less than 5 participants, the team shall receive the same cash incentives as individual medal winners, divided equally.
- For team events with 5 or more participants, each team member shall receive 25% of the cash incentives for individual medal winners.
- Demonstration and exhibition sports events in the Olympics shall receive 25% of the cash incentives for Olympic medalists.
- National athletes who surpass Philippine record or ranking in any measurable international sports competition shall be given cash incentives determined by the PSC.
- The PSC, upon consultation with the Philippine Amusement and Gaming Corporation (PAGCOR), may adjust the cash incentives every 3 years based on studies and consultations.

Cash Incentives for Coaches (Section 9):
- Coaches of national athletes who have personally trained and rendered service to the athletes or teams who win in international competitions for at least 6 months prior shall be entitled to cash incentives.
- The incentives for the coaches shall be equivalent to 50% of the cash incentives for gold, silver, and bronze medalists.
- In case of more than one coach, the cash incentives shall be divided among themselves.

Availment of Benefits and Privileges (Section 10):
- National athletes and coaches shall avail of the benefits and privileges upon presentation of a valid identification card, renewable every year, issued by the PSC.
- They shall not avail of said benefits and privileges in combination with similar benefits and privileges under other existing laws.

Penalties (Section 11):
- Violations of the discounts for national athletes and coaches shall be subject to fines ranging from P50,000.00 to P200,000.00 and/or imprisonment of 6 months to 6 years, depending on the number of violations.
- National athletes or coaches who abuse the privileges shall be punished with imprisonment of not less than 6 months or a fine of P5,000.00 to P50,000.00, or both.
- Corporations, partnerships, or juridical persons found violating the law shall have the penalty imposed on the president, owner, or any responsible officer.
- Alien or foreign violators shall be deported immediately after service of sentence.
- Business permits, permits to operate, franchises, and other similar privileges may be canceled or revoked for violators.

Funding (Section 12):
- The cash incentives and retirement benefits shall be taken from the net cash income of the PAGCOR, remitted directly as a special account to the National Sports Development Fund (NSDF) of the PSC, in addition to the regular income share of the PSC.
- Any additional funding requirement shall be sourced from the 50% national government share in the gaming revenue of PAGCOR.
- A separate fund equivalent to not less than 60% of the existing NSDF shall be automatically set aside for the training and preparation of national athletes.

Transitory Provision (Section 13):
- National athletes who have availed of the benefits and privileges under the repealed Republic Act No. 9064 are considered to have fully claimed their cash incentives.
- National athletes who have not availed of the cash incentives under the repealed law shall claim within 3 years from the effectivity of this Act, and thereafter would be construed as not eligible for the claim and have waived their rights.

Implementing Rules and Regulations (IRR) (Section 14):
- The PSC, in consultation with the POC, NPC PHIL, Department of Health (DOH), Department of Education (DepED), CHED, TESDA, Department of Finance (DOF), Bureau of Internal Revenue (BIR), PAGCOR, PHILHEALTH, among others, and other concerned agencies shall promulgate and issue the IRR within 60 days upon approval of this Act.

Monitoring and Reportorial Requirements (Section 15):
- The PSC shall submit a report on the benefits, privileges, and incentives granted under this Act to national athletes and coaches to the DOF, Department of Budget and Management (DBM), PAGCOR, Senate Committee on Games, Amusement and Sports, and House of Representatives Committee on Youth and Sports Development for monitoring purposes.
- The submission shall not be later than 3 years from the effectivity of this Act and every 3 years thereafter.

Repealing Clause (Section 16):
- Republic Act No. 9064, otherwise known as the "National Athletes, Coaches and Trainers Benefits and Incentives Act of 2001" or "Sports Benefits and Incentives Act of 2001", is hereby repealed.
- All laws, presidential decrees, executive orders, rules and regulations or parts thereof inconsistent with the provisions of this Act are hereby repealed, amended or modified accordingly.

Separability Clause (Section 17):
- If any provision or part hereof is declared unconstitutional, the remainder of this Act or any provision not affected shall remain in full force and effect.

Effectivity Clause (Section 18):
- This Act shall take effect 15 days after its publication in at least two newspapers of general circulation.
