Summary of Republic Act No. 9946Retirement, Survivorship, and Other Benefits for Members of the Judiciary
- Retirement Benefits (Section 1):
• Justices/Judges with at least 15 years of service in the government or judiciary who retire at age 70 or resign due to incapacity shall receive:
• Lifetime pension equal to their last salary plus highest monthly allowances (transportation, representation, PERA, additional compensation)
• Free tuition for one child in a state university/college for one bachelor's degree
• Justices/Judges aged 60 with at least 15 years of service (last 3 years continuous in judiciary) can retire and receive the same benefits
• Pro-rata pension for those with less than 15 years of service
• Conditions: Cannot appear as counsel against the government or collect fees related to government interests; cannot receive pension while holding an elective public office
- Survivorship Benefits (Section 2):
• If a Justice/Judge dies in service, their heirs shall receive:
• Lump sum of 5 years' gratuity based on highest salary and allowances if service is less than 15 years
• Lump sum of 10 years' gratuity if service is at least 15 years
• Lump sum of 10 years' gratuity if the Justice/Judge was killed due to their work, with at least 5 years of service
• Presumption of work-related death if intentionally killed while in service
- Retirement Gratuity and Annuity (Section 3):
• Upon retirement, Justices/Judges shall receive:
• Lump sum of 5 years' gratuity based on highest salary and allowances
• Lifetime monthly annuity after 5 years
• If retirement is due to permanent disability contracted during service:
• Lump sum of 10 years' gratuity
• If partial permanent disability, additional 2 years' lump sum gratuity
• Lifetime monthly annuity after 10 or 7 years, respectively
• Surviving spouse shall receive all retirement benefits if the Justice/Judge was eligible to retire at the time of death
- Automatic Pension Increase (Section 3-A):
• Pensions shall automatically increase whenever the salary of the same position increases
- Retroactive Application (Section 3-B):
• Benefits shall be granted to those who retired prior to this Act, but only prospectively
- Funding (Section 5):
• Initial implementation funded by current year's judiciary savings
• Subsequent funding through annual General Appropriations Act

AN ACT GRANTING ADDITIONAL RETIREMENT. SURVIVORSHIP, AND OTHER BENEFITS TO MEMBERS OF THE JUDICIARY, AMENDING FOR THE PURPOSE REPUBLIC ACT NO. 910, AS AMENDED, PROVIDING FUNDS THEREFOR AND FOR OTHER PURPOSES
Be it enacted by the Senate and the House of Representatives of the Philippines in Congress Assembled:
Section 1. Section 1 of Republic Act No. 910, as amended, is hereby further amended to read as follows:
"SECTION 1. When a Justice of the Supreme Court, the Court of Appeals, the Sandiganbayan, or of the Court of Tax Appeals, or a Judge of the regional trial court, metropolitan trial court, municipal trial court, municipal circuit trial court, shari'a district court, shari'a circuit court, or any other court hereafter established who has rendered at least fifteen (15) years service in the Judiciary or in any other branch of the Government, or in both, (a)...
