- Elected in the same manner and possesses the same qualifications as the Mayor. (Section 8)
- If the Vice-Mayor is temporarily incapacitated or the position is vacant, the duties of the Mayor shall be performed by the city treasurer as the acting mayor, with the same powers and duties as the Mayor. (Section 8)
- A member of the Municipal Board and performs duties assigned by the Mayor, law, or ordinance. (Section 8)
- Salary: Not exceeding ₱3,600 per year, but equivalent to the Mayor's salary when acting as Mayor. (Section 8)
The Municipal Board
- The legislative body of the city. (Section 11)
- Composed of the Mayor (presiding officer), Vice-Mayor, and seven councilors elected at large by popular vote during provincial and municipal elections, following the Revised Election Code. (Section 11)
- In case of sickness, absence, suspension, or temporary disability of a member, or to maintain a quorum, the President of the Philippines may appoint a temporary substitute from the same political party as the incapacitated member, with all rights and duties of a member until the regular incumbent returns. (Section 11)
- If a member is a candidate in an election, they are disqualified from acting with the Board on election matters. The other members shall discharge those duties without them or choose a disinterested elector to act with the Board in their stead. (Section 11)
- Members receive per diem as provided for in Republic Act No. 840. (Section 11)
Transition Provisions
- The appointive Mayor, Vice-Mayor, and all councilors serving on the date of approval of this Act shall continue in office until their successors are elected and qualified in the next general election for provincial and municipal officials, following the Revised Penal Code. (Section 2)

AN ACT MAKING ELECTIVE THE POSITIONS OF MAYOR AND VICE-MAYOR AND THE ENTIRE MEMBERSHIP OF THE MUNICIPAL BOARD OF THE CITY OF CAGAYAN DE ORO, AMENDING FOR THIS PURPOSE CERTAIN SECTIONS OF REPUBLIC ACT NUMBERED FIVE HUNDRED TWENTY-ONE.
Section 1. Sections seven, eight and eleven of Republic Act Numbered Five hundred twenty-one, otherwise known as the Charter of the City of Cagayan de Oro, are amended to read as follows:
Sec. 7. The Mayor. The Mayor shall be the chief executive of the city. He shall be elected by the qualified voters of the city during every election for provincial and municipal officials in accordance with the provisions of the Revised Election Code. No person shall be eligible for the position of mayor unless he is at least twenty-five years of age, a qualified voter and a resident of the city for not less than one year immediately preceding his election.
