AN ACT MAKING THE POSITION OF A COOPERATIVES DEVELOPMENT OFFICER MANDATORY IN THE MUNICIPAL, CITY AND PROVINCIAL LEVELS, AMENDING FOR THE PURPOSE REPUBLIC ACT NO. 7160, OTHERWISE KNOWN AS THE "LOCAL GOVERNMENT CODE OF 1991," AS AMENDED

SECTION 1. Section 443, Book III, Title Two, Chapter 2 of Republic Act No. 7160, is hereby amended to read as follows:

"SEC. 443. Officials of the Municipal Government. — (a) There shall be in each municipality a municipal mayor, a municipal vice-mayor, sangguniang bayan members, a secretary to the sangguniang bayan, a municipal treasurer, a municipal assessor, a municipal accountant, a municipal budget officer, a municipal planning and development coordinator, a municipal engineer/building official, a municipal health officer, and a municipal civil registrar. Summary of Republic Act No. 11535

Amending the Local Government Code of 1991 to Make the Position of a Cooperatives Development Officer Mandatory

- Mandates the appointment of a Cooperatives Development Officer (CDO) at the municipal, city, and provincial levels of local government units (Sections 1-3)
• Municipalities have the option to appoint a full-fledged CDO or merge the position with an existing related office/department (Section 1)
• Cities have the same option as municipalities regarding the CDO position (Section 2)
• Provinces must appoint a full-fledged CDO and set the rank, remuneration, and other emoluments subject to existing laws and regulations (Section 3)

- Qualifications for the CDO position (Section 4)
• Must be a Filipino citizen, preferably a resident of the local government unit (Section 4a)
• Must have a college degree, preferably in cooperatives, business administration with special training in cooperatives, or any related course (Section 4a)
• Must have a first-grade civil service eligibility or its equivalent (Section 4a)
• Must have experience in cooperatives organizations and management or other comparable experience of at least 5 years for provincial or city CDO, and 3 years for municipal CDO (Section 4a)

- Duties and responsibilities of the CDO (Section 4b)
• Take charge of the office for the development of cooperatives registered with the Cooperative Development Authority (Section 4b)
• Formulate measures for the sanggunian and provide technical assistance to the governor or mayor in delivering basic services and facilities through cooperatives (Section 4b1)
• Develop plans and strategies in consultation with the cooperative sector, and implement them upon approval by the governor or mayor (Section 4b2)
• Identify groups, sectors, or communities that can be organized into cooperatives for poverty reduction, job creation, and socioeconomic development (Section 4b3i)
• Provide assistance to prospective cooperatives in pre-registration seminars, pre-membership education seminars, and preparation of registration documents (Section 4b3ii)
• Provide technical and other forms of assistance to registered cooperatives, including training, education, business management, finance, and financial management (Section 4b3iii)
• Assist cooperatives in establishing linkages with government agencies, cooperative unions and federations, the academe, and other organizations involved in promoting cooperatives (Section 4b3iv)
• Assist cooperatives in developing and implementing risk management plans, business continuity plans, and management in response to calamities and disasters (Section 4b4)

- Repeals all laws, decrees, executive orders, rules and regulations, issuances or parts thereof inconsistent with this Act (Section 5)

- Takes effect 15 days after publication in the Official Gazette or a newspaper of general circulation (Section 6)
