AN ACT PROVIDING FOR THE ENFORCEMENT OF CONDITIONS MADE BY THE GOVERNOR-GENERAL IN THE EXERCISE OF HIS DISCRETION IN GRANTING CONDITIONAL PARDONS.

By authority of the United States, be it enacted by the Philippine Commission, that:

Section 1. Whenever the Governor-General1 shall, in his discretion, grant a conditional pardon to any person convicted of crime under the laws of the Philippine Islands, the conditions shall be fully set forth in the pardon and a copy of the conditional pardon shall in each case be delivered to the person so pardoned, and also a copy thereof filed in the office of the clerk of the Court of First Instance of the province or judicial district in which such person was tried and convicted.

Section 2.It shall be the duty of the clerk of the Court of First Instance to send a certified copy of each conditional pardon received by him, as provided in section one, to the provincial governor and to the senior inspector of Constabulary2 in the province, and in...

Enforcement of Conditions for Conditional Pardons

- Conditional pardons granted by the Governor-General (now President) must have conditions fully stated, with copies given to the pardoned person and filed with the Court of First Instance clerk. (Section 1)
- The Court clerk must send certified copies of conditional pardons to the provincial governor, senior Constabulary inspector (now Provincial Commander), and in Manila, to the city's chief of police and Director of Constabulary (now Chief of Constabulary). (Section 2)
- If the provincial fiscal or Manila's prosecuting attorney finds a conditional pardon's conditions violated, they can apply to the Court of First Instance for an arrest order against the pardoned person for investigation. (Section 3)

- The Act expedites its passage for public good. (Section 5)
- The Act takes effect upon passage. (Section 6)
