AN ACT PROVIDING FOR THE PROFESSIONALIZATION OF THE BUREAU OF FIRE PROTECTION (BFP) AND THE BUREAU OF JAIL MANAGEMENT AND PENOLOGY (BJMP), AMENDING CERTAIN, PROVISIONS OF REPUBLIC ACT NO. 6975, PROVIDING FUNDS THEREOF AND FOR OTHER PURPOSES
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Title. - This Act shall be known as the "Bureau of Fire Protection and Bureau of Jail Management and Penology Professionalization Act of 2004."

AN ACT PROVIDING FOR THE PROFESSIONALIZATION OF THE BUREAU OF FIRE PROTECTION (BFP) AND THE BUREAU OF JAIL MANAGEMENT AND PENOLOGY (BJMP)

Summary of Republic Act No. 9263 (Bureau of Fire Protection and Bureau of Jail Management and Penology Professionalization Act of 2004)
Objectives and Policies
- Declares the policy to maintain peace and order, protect life, liberty and property, and promote general welfare through strengthening fire and jail services. (Section 2)
- Recognizes the responsibility of the state to strengthen government capability in delivering basic services through institutionalizing efficient and competent fire and jail services. (Section 2)
- Aims to professionalize and restructure the Bureau of Fire Protection (BFP) and Bureau of Jail Management and Penology (BJMP) by upgrading qualifications of uniformed personnel and standardizing their base pay, retirement, and other benefits at par with the Philippine National Police (PNP) and Armed Forces of the Philippines (AFP). Organization and Key Positions
- The BFP and BJMP shall be headed by a Chief with the rank of Director, assisted by two Deputy Chiefs (one for Administration and one for Operations) with the rank of Chief Superintendent. (Section 3)
- The Chief of BFP and BJMP shall serve a tour of duty not exceeding 4 years, unless extended by the President during war or national emergency. (Section 3)
- Establishes the positions and ranks of officers in the national and regional offices of BFP and BJMP. (Section 3)
Professionalization and Qualification Standards
- Sets the minimum qualifications for appointment as uniformed personnel, including educational requirements, height and weight standards, age limits, and other criteria. (Section 4)
- Provides a 5-year transition period for current personnel to obtain the minimum educational qualification and 1 year for the weight requirement. (Section 4)
- Outlines the procedures for appointment of uniformed personnel at different ranks, involving the Regional Directors, Chiefs of BFP and BJMP, Secretary of DILG, and the President. (Section 5)
- Allows lateral entry of officers with specialized qualifications, such as engineers, accountants, lawyers, and medical professionals, at specific ranks. (Section 6)
- Establishes qualification standards for designation to key positions, such as Fire Marshals, Jail Wardens, Regional Directors, Deputy Chiefs, and Chiefs of BFP and BJMP, including educational and training requirements. (Section 7)
Attrition and Promotion Systems
- Requires the establishment of an attrition system within 1 year, including provisions for demotion, non-promotion, inefficiency, incapacity, and failure to complete required courses or eligibility. (Section 9)
- Mandates the establishment of a merit-based and gender-fair promotion system within 6 months, considering vacant ranks and requiring minimum qualifications, eligibility, and passing tests. (Section 10)
- Allows promotion to the next higher rank for acts of conspicuous courage and gallantry. (Section 10)
Performance Evaluation and Conduct
- Requires the establishment of a performance evaluation system based on rules, regulations, standards, and a code of conduct for uniformed personnel. (Section 11)
- The evaluation system shall consider annual psychiatric/psychological and physical tests. (Section 11)
Salary Standardization and Benefits
- Standardizes the minimum starting salary of uniformed personnel equivalent to the corresponding rank classification in the PNP and AFP. (Section 12)
- Provides a salary grade schedule for different ranks, ranging from Salary Grade 10 (Fire/Jail Officer I) to Salary Grade 28 (Fire/Jail Director). (Section 12)
- Ensures that current benefits received by uniformed personnel shall continue, and retirement pay shall be adjusted based on the prevailing scale of base pay. (Section 12)
