AN ACT REGULATING THE PRACTICE OF PHARMACY AND SETTING STANDARDS OF PHARMACEUTICAL EDUCATION IN THE PHILIPPINES AND FOR OTHER PURPOSES.
ARTICLE 1
Objectives and ImplementationSection 1. Objectives. This Act provides for and shall govern (a) the standardization and regulation of pharmaceutical education; (b) the examination for registration of graduates of schools of pharmacy and (c) the supervision, control and regulation of the practice of pharmacy in the Philippines.
Section 2. Enforcement. For the purposes of implementing the provisions of this Act, the Council of Pharmaceutical Education and the Board of Pharmacy are hereby created.

The Council of Pharmaceutical EducationSection 3. The Council of Pharmaceutical Education and its composition. Objectives and Implementation
- Standardizes and regulates pharmaceutical education in the Philippines. (Section 1)
- Creates the Council of Pharmaceutical Education and the Board of Pharmacy to implement the Act. (Section 2)
The Council of Pharmaceutical Education
- Composition: Secretary of Education (Chairman), Undersecretary of Health Services, Food and Drug Administrator, Chairman of the Board of Pharmacy, deans of colleges of pharmacy, and representatives of pharmaceutical organizations. (Section 3)
- Functions:
- Promulgate rules and regulations on pharmaceutical education. (Section 4a)
- Implement rules and regulations through proper agencies. (Section 4b)
- Accredit colleges of pharmacy and internship sites. (Sections 4c, 4d)
- Meets at least once a month, and members receive travel expenses. (Section 5)
The Board of Pharmacy and Examination and Registration of Pharmacists
- Composition: A Chairman and two members appointed by the President. (Section 6)
- Qualifications of Board members: Filipino citizen, registered pharmacist with 10 years of practice, good moral character, not a faculty member of a pharmacy school, and a member of a national pharmaceutical association. (Section 7)
- Tenure: 3 years, with a maximum of 6 consecutive years. (Section 8)
- Removal: By the President for neglect of duty, incompetence, malpractice, or unethical conduct, after an investigation. (Section 9)
- Powers and duties:
- Examine applicants and issue certificates of registration. (Sections 11a, 11b)
- Reprimand, suspend, or revoke certificates after an investigation. (Section 11c)
- Promulgate rules and regulations for enforcement of the Act. (Section 11d)
- Study conditions affecting pharmacy practice. (Section 11e)
- Check employment of qualified personnel in drug establishments. (Section 11f)
- Encourage development of botanical gardens and medicinal plants. (Section 11g)
- Detailmen (drug company representatives) must register with the Board and meet qualifications. (Section 12)
- Grounds for reprimand, suspension, or revocation of registration: conviction of violations, immoral conduct, fraud, negligence, malpractice, acting as a dummy for unqualified persons, addiction, insanity, false advertising, and violations of the Code of Ethics. (Section 13)
- Administrative investigation procedures. (Sections 14, 15, 16, 17)
- Qualifications for board examination candidates: Filipino citizen, good moral character, completion of internship program, and graduation from an accredited pharmacy program. (Section 18)
- Scope and weighting of theoretical and practical examinations. (Section 19)
- Passing score: 75% general average in both theoretical and practical examinations, with no more than two subjects below 50% in the theoretical examination. (Section 20)
- Examination held twice a year in Manila, with fees of ₱50 for examination and ₱20 for registration. (Sections 21, 22)
Practice of Pharmacy
- Definition of practicing pharmacy. (Section 23)
- Prerequisite: At least 21 years old, passed the board examination, and holds a valid certificate of registration. (Section 24)
- Sale of medicines, drugs, and devices only through prescription drugstores or hospital pharmacies. (Section 25)
- Markings and prohibition on sale of drug samples. (Section 26)
- Pharmacist required and minimum compensation in drug establishments. (Section 27)
- Display of certificate of registration required. (Section 28)
- Responsibility for quality of drugs. (Section 29)
- Filling and refilling of prescriptions. (Section 30)
- Labeling requirements for dispensed medicines. (Section 31)
- Record-keeping for prescriptions. (Section 32)
- Prohibition on use of ciphers or unusual terms in prescriptions and prescription switching. (Section 33)
- Provisions for dispensing violent poisons, including record-keeping and labeling requirements. (Section 34)
- Provisions for dispensing less violent poisons. (Section 35)
- Requirement for a separate cabinet for poisonous drugs. (Section 36)
- Provisions for dispensing abortifacients or anti-conceptional substances and devices, including record-keeping requirements. (Section 37)

Penal Provisions
- Penalties for violations of Sections 12, 24, 25, 26, 27, and 29: Fine of ₱1,000 to ₱4,000 or imprisonment of 6 months and 1 day to 4 years. (Section 40)
- Penalties for violations of Sections 28, 30, 31, 32, 33, 34, 35, 37, and 38: Fine of ₱100 to ₱500 or imprisonment of 30 days to 4 months. (Section 41)
- Non-citizens found guilty are subject to deportation after serving the sentence. (Section 41)
