REPUBLIC ACT NO. 10176
AN ACT REVIVING THE OBSERVANCE OF ARBOR DAY BY AUTHORIZING THE LOCAL GOVERNMENT UNITS THE RESPONSIBILITIES FOR CELEBRATING THE DAY FOR TREE PLANTING AS AN ANNUAL EVENT
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section 1. Short Title. – This Act shall be known as the "Arbor Day Act of 2012″.
Section 2. Declaration of Policy. – It is hereby declared the policy of the State to protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature. Towards this end, the vital role and importance of trees in ecological stability is recognized. Declaration of Policy (Section 2):
- Recognizes the vital role of trees in ecological stability.
- Mandates provinces, cities, and municipalities to revive Arbor Day for tree planting activities.
- Allows flexibility in setting Arbor Day dates to suit local conditions.
Creation of Arbor Day Committee (Section 3):
- Requires the creation of an Arbor Day Celebration Committee in every province, city, and municipality.
- The committee should preferably include representatives from various government agencies and organizations.
Proclamation of Arbor Day (Section 4):
- Local chief executives shall declare Arbor Day through an ordinance passed by the local council.
- Arbor Day may be declared a public working holiday to ensure participation.
Funding (Section 5):
- Local councils shall allocate resources for implementing the Act.
Information and Monitoring (Section 6):
- LGUs shall submit the actual date of Arbor Day Celebration to the DILG.
Supply and Distribution of Seedlings (Section 7):
- The BPI, in coordination with the PCA, shall supply and distribute seedlings to LGUs.
Planting of Trees (Section 8):
- All able-bodied citizens aged 12 and above shall plant one tree every year.
Areas Covered by Tree Planting (Section 9):
- The committee shall specify areas within the LGU for planting or reforestation.
- Tree planting shall be done in public school grounds, idle public lands, public parks, and private lands with owner's consent.
- Endemic or indigenous species shall be encouraged in protected areas.
Maintenance of Trees (Section 10):
- Barangay officials and deputized NGOs shall be responsible for maintaining the trees.
Implementing Rules and Regulations (Section 11):
- The DILG, in coordination with LGUs, DENR, and DA, shall promulgate rules and regulations for implementation.
