REPUBLIC ACT No. 10122

AN ACT STRENGTHENING THE LITERACY COORDINATING COUNCIL BY AMENDING REPUBLIC ACT NO. 7165, OTHERWISE KNOWN AS "AN ACT CREATING THE LITERACY COORDINATING COUNCIL, DEFINING ITS POWERS AND FUNCTIONS, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES".

Be it enacted by the Senate and, House of Representatives of the Philippines in Congress assembled:

Section 1. Republic Act No. 7165 IS hereby amended as follows:

"SECTION l. It is hereby declared to be the policy of the State to give the highest priority to the adoption of measures for the universalization of literacy.

"Toward this end, it shall encourage and rationalize the formulation of policies and the implementation of programs on nonformal, informal, and indigenous learning systems, as well as self-learning, independent, and out-of-school study programs particularly those that respond to community needs.

"The State shall institutionalize an interagency coordinating and advisory body...

Summary of Republic Act No. 10122

Strengthening the Literacy Coordinating Council

- Declares the policy of the State to prioritize measures for universalization of literacy. (Section 1)
- Encourages formulation of policies and implementation of programs on non-formal, informal, indigenous learning systems, self-learning, independent, and out-of-school study programs, particularly those responding to community needs. (Section 1)
- Institutionalizes an interagency coordinating and advisory body to synchronize and strengthen policies and efforts toward universalization of literacy. (Section 1)

Literacy Coordinating Council

- Creates the Literacy Coordinating Council as an inter-agency body administratively attached to the Department of Education. (Section 2)
- Outlines the composition of the Council, including representatives from various government agencies, educational institutions, and non-government organizations (NGOs) involved in literacy propagation. (Section 3)
- Provides for equal opportunity for designated representatives to vote and participate in Council deliberations. (Section 4)
- Allows reimbursement of actual expenses incurred by representatives during Council-related functions and duties. (Section 4)

Powers and Functions of the Council

- Act as the overall advisory and coordinating body, providing policy and program directions for all literacy endeavors in the country. (Section 5a)
- Engage services, expertise, and resources, including cooperation, assistance, and support of appropriate government agencies or NGOs involved in literacy. (Section 5b)
- Recommend strategies on developing a mass movement for promoting life skills and education towards universalization of literacy. (Section 5c)
- Formulate measures on monitoring and evaluation of the literacy situation in the country, including establishing and maintaining a national data bank and information exchange and dissemination system to support literacy efforts at national and local levels. (Section 5d)
- Assist in identifying and adopting successful management schemes of literacy programs, and adopt measures to boost research and development work in literacy by government agencies and NGOs involved in literacy work. (Section 5e)
- Formulate policies towards maximizing public and private sector support and involvement on literacy programs, projects, and activities. (Section 5f)
- Propose measures on how to organize and strengthen support structures for literacy at the regional, provincial, city, municipal, and barangay levels. (Section 5g)
- Perform other functions necessary in furtherance of the purposes of this Act. (Section 5h)

Secretariat and Staffing

- Organizes a secretariat headed by a Chief of Office, with staffing pattern, qualifications, duties, responsibilities, functions, and compensation determined by the Council, subject to the National Compensation and Classification Plan and other existing civil service rules and regulations. (Section 6)
- Extends permanent status to the existing secretariat staff, subject to existing civil service rules and regulations. (Section 6)
- Limits the amount for payment of employees' salaries, benefits, and other emoluments to not exceed forty percent (40%) of the Council's total annual appropriations. (Section 6)

Funding and Reporting

- Authorizes the appropriation of Twenty million pesos (Php20,000,000.00) from the National Treasury to carry out the functions of the Council. (Section 7)
- Requires the inclusion of the sum needed for the operation and maintenance of the Council in the annual budget of the Department of Education after the initial appropriation. (Section 7)
- Mandates the Council to submit an annual report to Congress, including policy recommendations requiring legislative action towards total eradication of illiteracy. (Section 7)

Implementation

- Requires the Council, in consultation with appropriate national government agencies, to promulgate the implementing rules and regulations within ninety (90) days from the effectivity of this Act. (Section 8)
- Repeals or modifies all laws, executive orders, presidential decrees, and other issuances or parts thereof inconsistent with the provisions of this Act. (Section 2)
- Provides for the separability clause, stating that if any part, section, or provision of this Act is declared unconstitutional, the other parts, sections, or provisions not affected shall remain in force and in effect. (Section 3)
- Sets the effectivity date of this Act to fifteen (15) days after completion of its publication in at least two (2) newspapers of general circulation. (Section 4)
