Officer Grade Distribution (Section 1):
- The Secretary of National Defense shall prescribe the authorized number of officers in each grade and service.
- Effective one year after approval, the officer grade distribution shall not exceed:
- 1.125% in the General/Flag Officer grade
- 6% in the grade of Colonel/Captain (PN)
- 12% in the grade of Lieutenant Colonel/Commander (PN)
- 18% in the grade of Major/Lieutenant Commander (PN)
- 20% in the grade of Captain/Lieutenant (PN)
- 42.875% in the grades of First Lieutenant/Lieutenant Junior Grade (PN) and Second Lieutenant/Ensign (PN)
- The Table of Organization shall be adjusted based on missions and officer requirements, and gradually decreased per prescribed rules.
- The officer to enlisted personnel ratio shall consider mission requirements, capabilities, scope of responsibility, technical nature, and equipment inventory.
- The Air Force and Navy shall have a higher officer to enlisted personnel ratio, not exceeding 15% of the Philippine Army's ratio.
- Officers in technical or administrative services may be eligible for promotion to general/flag officer grade.
- The quota limitation shall not apply to promotion of reserve officers in the inactive service.
- If the actual number in a grade is less than prescribed, the difference may be applied to increase the number in a lower grade.
Distribution of General/Flag Officers (Section 2):
- The number of general/flag officers shall be distributed as follows:
- General/Admiral (0-10): 1%
- Lieutenant General/Vice Admiral (0-9): 7%
- Major General/Rear Admiral (0-8): 30%
- Brigadier General/Commodore (0-7): 62%
- There shall only be one officer with the grade of General/Admiral at any time.
- The numbers for Major General/Rear Admiral, Lieutenant General/Vice Admiral, and General/Admiral shall be the maximum.
- If the actual number in a grade is less than prescribed, the difference may be applied to increase the number in the lower grade.
- No officer shall be promoted to Brigadier General/Commodore or higher unless there is an existing vacancy and the officer occupies a position in the Table of Organization that requires the grade.
Determination and Allocation of Key Positions (Section 3):
- The Secretary of National Defense, upon the recommendation of the Chief of Staff, AFP, shall determine and allocate the number of key positions among the major services, headquarters, and support units based on technical nature, position, task, scope and responsibilities, equipage, threats, and other considerations, subject to review by Congress.
Promotion and Designation/Assignment (Section 4):
- No officer shall be promoted or designated/assigned to Brigadier General/Commodore or higher unless there is an existing vacancy and the officer occupies a position in the Table of Organization that requires the grade.
- The President shall nominate and appoint officers from the rank of Colonel or Naval Captain, with the consent of the Commission on Appointments.
- The President can make appointments during Congressional recess, but these shall be effective only until disapproval by the Commission on Appointments or until the next adjournment of Congress.
Appropriations (Section 5):
- The initial implementation cost shall be charged against the appropriations savings of the AFP.
- Subsequent costs shall be included in the regular appropriations of the AFP in the annual General Appropriations Act.
Rules and Regulations (Section 6):
- The Department of National Defense, in coordination with the AFP and other relevant offices, shall formulate and issue the implementing rules and regulations.
Transitory Provisions (Section 7):
- Officers currently holding key positions may still be promoted to the corresponding rank even if they have less than one year remaining of active service, but must have held the position for at least six months before the law's effectivity.
Repealing Clause (Section 8):
- Sections 1 and 2 of Republic Act No. 8186 and all other inconsistent laws, rules, regulations, and issuances are repealed or modified accordingly.
Effectivity (Section 9):
- This Act shall take effect fifteen days after its complete publication in the Official Gazette or in two newspapers of general circulation, whichever comes earlier.
