Summary of Republic Act No. 3872Amendments to the Public Land Act (Commonwealth Act No. 141)
- Granting of Free Patents (Section 1):
• Natural-born Filipino citizens who have continuously occupied and cultivated agricultural public lands since July 4, 1926 or earlier, and have paid real estate tax, are entitled to a free patent for up to 24 hectares of land. (Section 44)
• Members of national cultural minorities who have continuously occupied and cultivated lands since July 4, 1955, are entitled to the same right, provided they do not own any real estate at the time of application. (Section 44)
- Confirmation of Claims and Issuance of Certificates of Title (Section 2):
• Certain citizens occupying public lands or claiming ownership but without perfected titles can apply to the Court of First Instance for confirmation of claims and issuance of certificates of title under the Land Registration Act. (Section 48)
• This includes those who applied for land grants before the transfer of sovereignty from Spain to the U.S. but did not receive titles, provided they have continuously occupied and cultivated the lands. (Section 48(a))
• Those who have been in continuous, exclusive, and notorious possession of agricultural public lands for at least 30 years under a bona fide claim of ownership, except when prevented by force majeure. (Section 48(b))
• Members of national cultural minorities who have been in open, continuous, exclusive, and notorious possession of public lands suitable for agriculture for at least 30 years under a bona fide claim of ownership. (Section 48(c))
- Validity of Conveyances and Encumbrances by National Cultural Minorities (Section 3):
• Conveyances and encumbrances made by literate members of national cultural minorities are valid if they can read and understand the language of the instrument. (Section 120)
• Conveyances and encumbrances made by illiterate members or those who do not understand the language are not valid unless approved by the Chairman of the Commission on National Integration. (Section 120)
- Repealing Clause and Effectivity (Sections 4 and 5):
• Any contrary laws, rules, regulations, or executive orders are amended or repealed accordingly. (Section 4)
• The Act took effect upon its approval on June 18, 1964. (Section 5)

REPUBLIC ACT No. 3872
AN ACT TO AMEND SECTIONS FORTY-FOUR, FORTY-EIGHT AND ONE HUNDRED TWENTY OF COMMONWEALTH ACT NUMBERED ONE HUNDRED FORTY-ONE, AS AMENDED, OTHERWISE KNOWN AS THE "PUBLIC LAND ACT", AND FOR OTHER PURPOSES.
Section 1. A new paragraph is hereby added to Section 44 of Commonwealth Act Numbered One hundred forty-one, to read as follows:
"Sec. 44. Any natural-born citizen of the Philippines who is not the owner of more than twenty-four hectares and who since July fourth, nineteen hundred and twenty-six or prior thereto, has continuously occupied and cultivated, either by himself or through his predecessors-in-interest, a tract or tracts of agricultural public lands subject to disposition, or who shall have paid the real estate tax thereon while the same has not been occupied by any person shall be entitled, under the provisions of this chapter, to have a free patent issued to him for such tract or tracts of such land not to exceed twenty-four hectares.
