Case Overview and Summary
Leasing of Forest Land for Special Purposes- The Director of Forestry, with the approval of the Secretary of Agriculture and Commerce, may lease or grant permits for the use of forest lands or vacant public lands not declared agricultural land to Filipino citizens or authorized associations for the following purposes: (Section 1)
• Establishment of sawmills, lumber yards, timber depots, logging camps, rights-of-ways, and plantations for raising nipa and/or other palms, bacauan, medicinal plants, or trees of economic value.
• Construction of hotels, sanatoria, bathing establishments, residences, camps, fishponds, saltworks, and pastures for large or small cattle.
• Other lawful purposes.
- The lease or permit period shall not exceed 25 years. (Section 1)
- The maximum area allowed for different purposes is as follows: (Section 1)
• 24 hectares for hotels, sanatoria, bathing establishments, residences, camps, fishponds, saltworks, pastures for large or small cattle, and other lawful purposes.
• 2,000 hectares for pastures and plantations for raising medicinal plants or trees of economic value.
• 200 hectares for fishponds, saltworks, nipa and/or other palms, or bacauan plantations, and rights-of-way.
- Persons or associations occupying or using forest land or vacant public land without a permit or lease shall be liable to pay twice the regular rentals for the period of illegal use or occupation. (Section 1)
- Permit or lease holders who fail to pay the regular rental charges shall be liable to pay additional charges of 10% to 100% of the regular rental charges. (Section 1)
- All acts or parts of acts inconsistent with this Act are repealed. (Section 2)
- This Act shall take effect upon its approval. (Section 3)

Section 1. Section eighteen hundred and thirty-eight of Act Numbered Twenty-seven hundred and eleven, known as the Revised Administrative Code, as amended at Act Numbered Thirty-eight hundred and twenty and Commonwealth Act Numbered One hundred, is hereby further amended to read as follows:
"Sec. 1838.
