AN ACT TO POSTPONE THE MAY 9, 1988 BARANGAY ELECTIONS TO THE SECOND MONDAY OF NOVEMBER THIS YEAR AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled::

Section 1. The elections of barangay officials set on the second Monday of May this year, as provided by law, is hereby postponed and reset to the second Monday of November this year and the subsequent barangay elections to be held every five (5) years thereafter.

Section 2. The term of office of barangay officials shall be for five (5) years from the first day of January following their election: provided, however, that no kagawad shall serve for more than two (2) successive terms.

Summary of Republic Act No. 6653

Postponement of Barangay Elections
- The barangay elections scheduled for the second Monday of May 1988 are postponed to the second Monday of November 1988. (Section 1)
- Subsequent barangay elections will be held every five (5) years thereafter.

Term of Office for Barangay Officials
- The term of office for barangay officials is five (5) years from the first day of January following their election. (Section 2)
- No kagawad shall serve for more than two (2) successive terms.

Application of Omnibus Election Code and COMELEC Rules
- The Omnibus Election Code shall apply to barangay elections as far as practicable. (Section 3)
- The Commission on Elections (COMELEC) shall promulgate necessary resolutions, rules, and regulations to implement the provisions of this Act.

Incumbent Barangay Officials
- Elected incumbent barangay officials shall remain in office until their successors are elected and qualified, unless sooner removed for cause. (Section 4)
- Designated or appointed incumbent barangay officials shall undergo a performance audit to determine their fitness to continue in office, conducted by the Secretary of Local Government with assistance from other agencies or organizations.
- Vacancies due to resignation or removal shall be filled by incumbent kagawads, with due recognition of their succession. If there is a default, the Secretary of Local Government shall appoint officers-in-charge, considering integrity, competence, and actual voting residency in the barangay.

Composition of Sangguniang Barangay
- There shall be a Sangguniang Barangay in every duly constituted barangay, composed of seven (7) kagawads elected by the barangay electorate. (Section 5)
- The Punong Barangay shall be elected by a majority vote of all members of the Sangguniang Barangay on the first day of their term and shall be the presiding officer.
- If no Punong Barangay is elected after two ballotings, the election shall be by mere plurality of votes.

Recall of Punong Barangay
- The Punong Barangay may be recalled for loss of confidence by an absolute majority vote of the Sangguniang Barangay, embodied in a resolution that includes the successor, likewise elected by an absolute majority vote. (Section 6)
- The recalled Punong Barangay shall retain and assume the position of kagawad.
- No recall shall take place within one (1) year immediately following the election as Punong Barangay and one (1) year immediately preceding the next barangay election.

Repealing Clause and Effectivity
- All laws, decrees, executive orders, orders, or resolutions inconsistent with this Act are repealed or modified accordingly. (Section 7)
- This Act shall take effect upon its approval. (Section 8)
