M a n i l aPRESIDENTIAL DECREE No. 1442
AN ACT TO PROMOTE THE EXPLORATION AND DEVELOPMENT OF GEOTHERMAL RESOURCES
WHEREAS, it is necessary for the economic and industrial development of the country to reduce our dependence on imported energy supplies and accelerate the development of geothermal resources which have been identified as a viable and untapped economical source of energy;
WHEREAS, it is in the national interest to allow service contracts for financial, technical, management or other forms of assistance with qualified domestic and foreign entities, for the exploration, development, exploitation, or utilization of the country's geothermal resources;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution of the Philippines, do hereby order and decree as follows:
Section 1. Exploration of and Development of Geothermal Resources by the Government. Subject to existing private rights, the Government may directly explore for, exploit and develop geothermal resources. It may also indirectly undertake the same under service contracts awarded through public...

Presidential Decree No. 1442
Summary of Presidential Decree No. 1442
An Act to Promote the Exploration and Development of Geothermal Resources
- Allows the government to directly explore, exploit and develop geothermal resources, or indirectly through service contracts with domestic or foreign contractors. (Section 1)
- Defines geothermal resources as products of geothermal processes, including steam, hot water, hot brines, gases, and associated energy. (Section 1)
Geothermal Contract Areas:
- Service contracts may cover public lands, government reservations, unappropriated areas, and areas covered by existing exploration permits or leases. (Section 2)
- Service contracts may also cover private lands, subject to court approval and payment of compensation to landowners. (Section 2)
Conversion of Existing Permits and Leases:
- Holders of valid geothermal exploration permits and leases granted before January 17, 1973, must enter into service contracts within six months, or their permits/leases will be canceled. (Section 3)
- All pending geothermal exploration permit applications under Republic Act No. 5092 are deemed withdrawn. (Section 3)
Privileges of Service Contractors:
- Exemption from tariff duties and compensating tax on imported machinery, equipment, spare parts, and materials required for geothermal operations, subject to conditions. (Section 4a)
- Entry of alien technical and specialized personnel, including their families, subject to approval and conditions. (Section 4b)
- Repatriation of capital investment, remittance of earnings, and payment of foreign obligations, subject to Central Bank regulations. (Section 4c)
- Other privileges provided in Section 12 of Presidential Decree No. 87, as applicable. (Section 4d)
Exploitation Permits:
- The Bureau of Energy Development may issue development and exploitation permits for geothermal resources deemed inappropriate for service contracts, and formulate applicable rules and regulations. (Section 5)
Rules and Regulations:
- The Director of Energy Development is authorized to promulgate necessary rules and regulations, subject to approval by the Secretary of Energy. (Section 6)
Repealing Clause:
- Provisions of Republic Act No. 5092 and other inconsistent laws, rules, and regulations are repealed. (Section 7)
Effectivity:
- This Decree takes effect immediately upon approval. (Section 8)
