AN ACT TO PROVIDE FOR THE ORGANIZATION OF A NATIONAL EMPLOYMENT SERVICE
(REPEALED BY PRESIDENTIAL DECREE NO. 442)

SECTION 1. National Employment Service; Creation of. - In order to ensure the best possible organization of the employment market as an integral part of the national program for the achievement and maintenance of maximum employment and the development and use of productive resources, there is hereby established a national system of free public employment offices to be known as the National Employment Service, hereinafter referred to as the Service. The Service shall be under the executive supervision and control of the Department of Labor, and shall have a chief who shall be known as the Commissioner of the National Employment Service hereinafter referred to as Commissioner. Said Commissioner shall be appointed by the President of the Philippines with the consent of the Commission on Appointments and shall receive compensation at the rate of nine thousand pesos per annum. Placement and Recruitment
- Assist workers in obtaining suitable employment and employers in obtaining suitable workers (Section 5a)
- Register applicants, obtain job vacancy information, refer applicants to vacancies, and facilitate worker mobility (Section 5a)
- Observe neutrality in industrial disputes and non-discrimination (Section 5a)
- Not refer workers to jobs with substandard wages or conditions (Section 5a)
- Facilitate occupational, industrial, and geographic mobility of workers (Section 5b)
- Develop specialization by occupation and industry in employment offices (Section 5c)
- Provide placement services for veterans, women, juveniles, and disabled persons (Section 5d)
- Furnish employment information to government entities (Section 5)

Employment Counselling and Testing
- Establish counselling and testing services for vocational guidance and readjustment (Section 6)
- Coordinate with other vocational guidance, training, and rehabilitation services (Section 6)
- Extend counselling and testing to specific groups like new workers, long-term unemployed, and rural surplus manpower (Section 6)
- Assist in obtaining vocational training or retraining (Section 6)

Transfer of Workers
- Take steps to remove economic barriers to worker transfer (Section 7)
- Provide financial assistance for necessary worker transfers (Section 7)
- Arrange for employers to pay transfer expenses for recruited workers (Section 7)
- Provide information on employment and living conditions in other areas (Section 7)
- Discourage migration to areas with labor surplus or housing shortage (Section 7)

Employment Market Information and Analysis
- Collect and disseminate detailed information on employment market situation (Section 8)
- Cooperate with other agencies on policies related to industry, public works, technology, migration, housing, and community planning (Section 8)
- Draw up annual manpower budget with anticipated labor demand and supply (Section 8)

Penalty
- Violators of the Act or regulations shall be fined between 100 and 1,000 pesos or imprisoned for 30 days to 6 months, or both (Section 9)

Staffing and Training
- Appoint staff members subject to civil service rules (Section 10a)
- Staff should be independent, qualified, and free from political influence (Section 10b)
- Require adequate training for staff appointments (Section 10c)
- Organize special training course and civil service exam for applicants (Section 10c)
- Establish permanent training program for staff (Section 10c)
